CITY ATTORNEY’S IMPARTIAL ANALYSIS

At the General Municipal Election held on April 13, 1982, Measure L was approved making the office of Mayor in the City of Brentwood an elective office, beginning with the Municipal Election in 1984, and every two years thereafter.

The first election for the office of Mayor was held in the City of Brentwood on November 6, 1984, at which time a Mayor was elected to a two-year term of office.  In June 1986 a ballot measure was submitted to eliminate the elected office of Mayor, but the ballot measure was defeated.

On June 13, 2000, the Brentwood City Council adopted Resolution No. 2094 proposing a measure for the elimination of the elective office of Mayor, and thereby reestablish the procedure for selection of the Mayor by the City Council which shall be submitted to the voters of the City of Brentwood at the next General Election to be held on November 7, 2000.

The foregoing action of the City Council was taken pursuant to the authority set forth in Government Code Section 34902(b), If a majority of the votes cast on the measure are in favor of the elimination of the office of elective Mayor, such office shall be eliminated on the expiration date of the incumbent Mayor’s term, and on such date the procedure of selection of Mayor by the members of the City Council, as provided for in Government Code Section 36801, shall be reestablished.

This analysis is prepared as an impartial analysis of the measure, as required by Section 5011 of the State Elections Code.
