RECOMMENDATION
Staff recommends authorizing the City Manager to take all appropriate actions to delete the proposed Contra Costa Community College District site from the Vineyards at Marsh Creek annexation petition

BACKGROUND
On April 13, 2004, the City Council approved Resolution No. 2004-84 that initiated an application to the Contra Costa County Local Agency Formation Commission (“LAFCO”) for annexation No. 02-01 referred to as the Vineyards at Marsh Creek Project, Contra Costa Community College District site, and the John Marsh House site, consisting of approximately 624 acres.

ANALYSIS
The City is aware that there is opposition to the inclusion of the Contra Costa Community College (“College”) site as part of the Vineyards at Marsh Creek annexation petition. The opposition is based upon the College not owning the approximately 30-acre site when the application is considered by LAFCO. If the College does not begin construction of a campus facility within its option period, the opposition believes that the property could be used for other land uses, without LAFCO’s review and approval, as the 30 acre site would then be under the City’s jurisdiction that includes land use decisions. To eliminate this possible opposition, City staff is proposing the City Council authorize the City Manager to take all appropriate actions to delete the College site from area proposed to be annexed by Resolution No. 2004-84. The College campus site could then be annexed when the College is ready to start construction which will secure the property ownership.

The City Manager sent the attached letter to LAFCO in order to expedite the rapidly approaching LAFCO’s review of the Vineyards at Marsh Creek annexation petition. The primary owner of the land subject to annexation, Vineyards at Marsh Creek, LLC, has been informed of this action and supports the deletion.

The proposed action would affirm the City Manager’s letter, remove the possible opposition to the annexation application, and authorize future actions by the City Manager to delete the College site from the petition and postpone the College site annexation until the ownership of the College site has been transferred to the College.

Dear LAFCO Board:

Please accept this letter as Brentwood’s official request that the Commission exclude the 30-acre proposed community college site from this annexation request.

Brentwood is strongly in favor of the development of this 30-acre site as a community college site, and looks forward to working with the college district to make it happen. Unfortunately, there seems to be a concern that if the college district does not take ownership of this 30-acre parcel, the City might want to develop it as houses. This possibility is not in the best interest of the City or East County, and the City would strongly oppose such a move. To eliminate that as a possibility, we are happy to temporarily postpone that part of the annexation request until the ownership transfer to the college district is imminent.
