Subject/Title: Adopt a Resolution authorizing the Agency Treasurer to appropriate funds from the Redevelopment Agency of the City of Brentwood Tax Allocation Bonds, Series 2001, to fund a portion of CIP Project No. 592-5913, Sewer Collection System Upgrade in Downtown in the amount of $177,600.

RECOMMENDATION
Adopt a Resolution authorizing the Agency Treasurer to appropriate funds from the Redevelopment Agency of the City of Brentwood Tax Allocation Bonds, Series 2001, to fund a portion of CIP Project No. 592-5913, Sewer Collection System Upgrade in Downtown in the amount of $177,600.

PREVIOUS ACTION
On May 25, 2004, by Resolution No. 2004-113, the City Council adopted the City’s 2004/05 – 2008/09 Capital Improvement Program that included CIP Project No. 592-5913, Sewer Collection System Upgrade in Downtown. This project is partially funded by the Brentwood Redevelopment Agency.

On March 8, 2005, the Agency approved revised Redevelopment Agency project priorities funded by the 2001 Tax Allocation Bond Proceeds and coordinated with Capital Improvement Program. This project priority list included the Sewer Collection System Upgrade in Downtown – CIP Project No. 592-5913.

On March 22, 2005, Council adopted a resolution approving a Reimbursement Agreement with Signature Properties, Subdivision No. 8537, located south of Chestnut Street and east of Garin Parkway, for costs associated with Master Plan Facility Improvements. A portion of the Reimbursement Agreement included upgrades to the Downtown sewer collection system in the amount of $177,600.

BACKGROUND
In conjunction with the Garin Corners Commercial Development, the City had requested Signature Properties to redirect the downtown sewer flow down Chestnut Avenue to the east interceptor sewer line. This was primarily due to the accumulated impact this project may have on the already overtaxed existing sewer system in the Downtown Area. This work is considered offsite and is therefore 100% reimbursable to the developer. The actual cost associated with the Chestnut Street sewer interceptor and the 12” sewer main between Third Street and Birchwood Road is $177,600.

This project is the beginning to rehabilitate old, antiquated infrastructure to facilitate redevelopment of the Downtown Area.

FISCAL IMPACT
The $177,600 shall be funded entirely by the Redevelopment Agency’s Tax Allocation Bonds, Series 2001.

A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF BRENTWOOD AUTHORIZING THE AGENCY TREASURER TO APPROPRIATE FUNDS FROM THE REDEVELOPMENT AGENCY OF THE CITY OF BRENTWOOD TAX ALLOCATION BONDS, SERIES 2001, TO FUND A PORTION OF CIP PROJECT NO. 592-5913, SEWER COLLECTION SYSTEM UPGRADE – DOWNTOWN IN THE AMOUNT OF $177,600.


WHEREAS, on May 25, 2004, by Resolution No. 2004-113, the City Council adopted the City’s 2004/05 – 2008/09 Capital Improvement Program that included CIP Project No. 592-5913, Sewer Collection System Upgrade in Downtown.

NOW, THEREFORE BE IT RESOLVED that the Redevelopment Agency of the City of Brentwood does hereby authorize the Agency Treasurer to appropriate funds from the Redevelopment Agency of the City of Brentwood Tax Allocation Bonds, Series 2001 to fund a portion of CIP Project No. 592-5913, Sewer Collection System Upgrade in Downtown in the amount of $177,600.
