REDEVELOPMENT AGENCY AGENDA ITEM NO. 3

Meeting Date: March 8, 2005

Subject/Title: Adopt a Resolution authorizing the Executive Director or his/her designee to accept a Grant Deed transferring ownership of the property acquired for the Police Station – CIP Project No. 336-3110 located at 1000 Central Boulevard (APN 017-160-004), to the Brentwood Redevelopment Agency.

RECOMMENDATION
Adopt a Resolution authorizing the Executive Director or his/her designee to accept a Grant Deed hereby accepting real property on behalf of the Brentwood Redevelopment Agency transferring ownership of the property located at 1000 Central Boulevard (APN 017-160-004) acquired for the New Police Station – Central Boulevard Property, CIP Project No. 336-3110, and execute any other documents as may be needed to complete the transfer.

PREVIOUS ACTION
On December 14, 1999, by Resolution No. 99-256, the City Council approved the purchase of the police station site at Central Boulevard, in the amount of $644,688.

On November 7, 2001, the voters passed a Bond Measure (Measure “J”) directing the City of Brentwood to issue a General Obligation Bond in the amount of $6,000,000 for the purpose of constructing a new police facility.

On May 28, 2002, by Resolution No. 2549, the City Council adopted the City’s 2002/03 – 2006/07 Capital Improvement Program that included the New Police Station, CIP Project No. 336-3110.

On September 9, 2003, Council instructed staff to complete the purchase of 9100 Brentwood Boulevard based on the terms approved by City Council for the New Police Station site. (Now known as New Police Station, CIP Project No. 336-3142)

On September 17, 2003, by Resolution No. 2980, the City Council approved authorization for the City Manager to execute a purchase agreement for 9100 Brentwood Boulevard, APN 010-160-015, New Police Station, CIP Project No. 337-3142.

On January 11, 2005, by Resolution No. 2005-1, the City Council adopted an Amendment to Site Lease and an Amendment to Sublease in connection with the Brentwood Infrastructure Financing Authority Revenue Refunding Bonds, Series 2002A and Subordinated Series 2002B.
The purpose of this action was to remove the prior lease encumbrance from the old police station site at 1000 Central Boulevard and substitute it with property located west of and adjacent to Fairview Avenue and south of Baldwin Drive, APN 010-510-025. This action essentially placed the title of 1000 Central Boulevard in condition for transfer to the Agency.

BACKGROUND
A due diligence analysis was performed as to the viability to move the Police Station Project from 1000 Central Boulevard to 9100 Brentwood Boulevard. The studies indicated that 9100 Brentwood Boulevard was in fact a good option for City use and would be a beneficial location for the police facility.

Transfer of 1000 Central Boulevard from City ownership to Agency ownership will better facilitate the sale of 1000 Central Boulevard. The Agency has the legal authority to actively participate in a public/private development of the property for economic development purposes. Redevelopment staff anticipates soliciting proposals from interested parties to be considered for selection as Master Developer to develop 1000 Central Boulevard in conformance with the Downtown Specific Plan. Upon selection of a Master Developer, the Agency would enter into a Disposition and Development Agreement (DDA) setting out the specific obligations of the developer and the Agency, including the terms of disposition of the property.

FISCAL IMPACT
The Agency will fund the commission of land appraisal, preparation and solicitation of development proposals and legal services for preparation of a Disposition and Development Agreement. Staff anticipates $5,000 for NPDES (storm water) maintenance for fiscal year 05/06. These costs will be funded from the Agency’s Administration Fund 301.

At this time, no funds shall be paid by the Agency to the City for 1000 Central Boulevard. The Agency shall commission an appraisal of the property for the purpose of negotiating a DDA with the selected developer. Upon transfer of the property from the Agency to the developer, the City shall be paid for the property as proposed by DDA negotiations. The DDA terms and conditions will be brought to the Council and Agency for approval.

A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF BRENTWOOD AUTHORIZING THE EXECUTIVE DIRECTOR OR HIS/HER DESIGNEE TO ACCEPT A GRANT DEED HEREBY ACCEPTING REAL PROPERTY ON BEHALF OF THE BRENTWOOD REDEVELOPMENT AGENCY TRANSFERRING OWNERSHIP OF THE PROPERTY LOCATED AT 1000 CENTRAL BOULEVARD (APN 017-160-004) ACQUIRED FOR THE NEW POLICE STATION – CENTRAL BOULEVARD PROPERTY, CIP PROJECT NO. 336-3110 AND EXECUTE ANY OTHER DOCUMENTS AS MAY BE NEEDED TO COMPLETE THE TRANSFER.

WHEREAS, On January 11, 2005, by Resolution No. 2005-1 the City Council adopted an Amendment to Site Lease and an Amendment to Sublease in connection with the Brentwood Infrastructure Financing Authority Revenue Refunding Bonds, Series 2002A and Subordinated Series 2002B; and

WHEREAS, transfer to the Brentwood Redevelopment Agency is necessary to facilitate and participate in economic development activities for job creation, increased property taxes, and encouragement of private investment within the Merged Redevelopment Project areas; and

WHEREAS, a Grant Deed must be executed and recorded to transfer ownership to the Redevelopment Agency of the City of Brentwood.

NOW, THEREFORE BE IT RESOLVED that the Redevelopment Agency of the City of Brentwood authorizes the Executive Director or his/her designee to accept a Grant Deed hereby accepting real property on behalf of the Brentwood Redevelopment Agency transferring ownership of the property located at 1000 Central Boulevard (APN 017-160-004) and execute any other documents as may be needed to complete the transfer.
