Subject/Title: Authorize Executive Director to execute a Professional Services Agreement with Consolidated Engineering Laboratories to perform the Phase I Environmental Site Assessments for the required Environmental Impact Report for a Potential Retail/Parking Structure in Downtown District, and approve a Resolution authorizing the Agency Treasurer to use Funds from the Redevelopment Agency of the City of Brentwood Tax Allocation Bonds, Series 2001, to fund this Agreement.

Authorize the Executive Director to execute a professional services agreement between Consolidated Engineering Laboratories and the Brentwood Redevelopment Agency in an amount of $3,800 to perform Phase I Environmental Site Assessments for the required Environmental Impact Report for a potential retail/parking structure in the Downtown District, and approve a Resolution authorizing the Agency Treasurer to use Funds from the Redevelopment Agency of the City of Brentwood Tax Allocation Bonds, Series 2001, to fund this Agreement.
At its meeting of May 14, 2002, the Redevelopment Agency Board directed staff to configure three proposed study areas for consideration of a potential retail/parking structure in the Downtown District.
At its meeting of November 26, 2002, the Redevelopment Agency Board accepted the Parking Study Phase I Report. The Phase I Report recommended two parking structure options for further study and investigation; both are full-block options. The Redevelopment Subcommittee supported this recommendation. Of the three proposed study areas, only two study areas can accommodate a full-block option: Study Area 1 and Study Area 2. This report was approved unanimously by the Agency.
On May 27, 2003, a presentation was made to a joint workshop of the Redevelopment Agency and Planning Commission outlining the similarities and differences of the two parking structure options. The presentation also included computerized graphics of two parking structures options at Study Area 1 and Study Area 2. The Agency and Planning Commission gave direction to staff to continue its investigation of this project.
On August 12, the Chair and Agency members requested a re-presentation of the November 26, 2002, Phase I Report. The special meeting for this re-presentation, and the re-affirmation or denial of past actions, was held earlier this evening.
To address identified parking deficiencies in the Downtown District, the Redevelopment Agency and Planning Commission commissioned a study of a potential retail/parking structure. The proposed structure will consist of approximately 31,000 square feet of retail on the first floor with three stories of parking. At this time, two parking structure options and two sites are being studied and investigated, for a total of four options.
Part of the continued investigation includes the preparation of a required Environmental Impact Report (EIR) and is needed to analyze such issues as traffic, air quality, noise and biological resources. A Phase I Environmental Site Assessment is required as an integral part of the EIR preparation. Study Area 1 and Study Area 2 will be investigated in the Phase I Environmental Site Assessment for the EIR.
Consolidated Engineering Laboratories will perform the Phase I Environmental Site Assessments and shall include visual reconnaissance of the properties, and review of historical records, regulatory data bases and chain of title reports. This work is currently anticipated to be complete by mid-September 2003.
Consolidated Engineering Laboratories specializes in environmental assessments and testing. They are the next firm available from the Engineering Department’s rotational list for soil and material testing firms. Based of their qualifications and expertise, we are recommending Consolidated Engineering Laboratories for the preparation of the Phase I Environmental Site Assessment study for this project.
Should the Agency’s decision earlier this evening result in adding other study area(s) to the investigation of a retail/parking structure, staff requests tonight’s consideration to approve this agreement for Phase I Environmental Site Assessment be postponed until a new proposal can be submitted, wherein additional study area(s) shall be included in the scope and fees.
The proposed amount as shown on the attached proposal is $3,800, and has been accounted for in the Redevelopment Agency Budget. This contract shall be funded entirely by the Redevelopment Agency’s Tax Allocation Bond proceeds.

A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF BRENTWOOD AUTHORIZING THE AGENCY TREASURER TO USE A PORTION OF THE AGENCY’S 2001 TAX ALLOCATION BONDS PROCEEDS TO FUND THE PROFESSIONAL SERVICES AGREEMENT WITH CONSOLIDATED ENGINEERING LABORATORIES TO PERFORM THE PHASE I ENVIRONMENTAL SITE ASSESSMENTS FOR THE REQUIRED ENVIRONMENTAL IMPACT REPORT FOR A POTENTIAL RETAIL/PARKING STRUCTURE IN DOWNTOWN DISTRICT
WHEREAS, the Redevelopment Agency of the City of Brentwood (“Agency”) adopted its 2003-2004 Budget on June 10, 2003, by Resolution No. RA-69; and
WHEREAS, the Agency desires to memorialize its expenditure approvals for redevelopment programs and activities that are funded by the Agency’s 2001 Tax Allocation Bond Proceeds that promote, establish, develop and support economic development, business and affordable housing opportunities within the Merged Redevelopment Project Areas; and
WHEREAS, the preparation of a Phase I Environmental Site Assessment Study is needed as a part of the required environmental impact report for a potential retail/parking structure in the Downtown District; and
WHEREAS, the Agency desires to fund the Phase I Environmental Site Assessment Study necessary for a potential retail/parking structure in the Downtown District.
NOW, THEREFORE BE IT RESOLVED that the Redevelopment Agency of the City of Brentwood authorizes the Agency Treasurer to use a portion of the Agency’s 2001 Tax Allocation Bond Proceeds to fund the professional services agreement with Consolidated Engineering Laboratories to perform the Phase I Environmental Site Assessment Study for the required environmental impact report for a potential retail/parking structure in the Downtown District in the amount of $3,800.
