Subject/Title: Approve Resolution authorizing the Agency to fund an additional $6,000 for bike racks and additional lighting to complete the construction of the Second Street Parking Lot, CIP Project No. 336-3135.

RECOMMENDATION
Approve a Resolution authorizing the Agency to fund an additional $6,000 for bike racks and additional lighting to complete the construction of the Second Street Parking Lot, CIP Project No. 336-3135.

PREVIOUS ACTION
On May 28, 2002, the City Council approved and adopted the 2002/07 Capital Improvement Program for the City, of which the Second Street Parking Lot, CIP Project No. 336-3125, is a part.
On November 12, 2002, the City Council awarded a contract in the amount of $45,462.50 plus 10% contingency to Antioch Paving Company, Inc. to construct the Second Street Parking Lot, CIP Project No. 336-3135.
This project was funded in full by the Redevelopment Agency by its Resolution RA-63 on November 12, 2002, in the amount of $45,462.50 plus 10% contingency.

BACKGROUND
As part of the City’s desire to make more parking available around City Hall and the downtown business area, staff explored and evaluated different alternatives. Just over the last year, the City has constructed two parking lots in the downtown area; both funded by the Redevelopment Agency. Continuing the efforts to improve parking availability, the Second Street Parking Lot has added an additional highly desired 52 parking spaces to the downtown business area, and reduced parking congestion around City Hall and the downtown area. This parking lot is providing major relief at a minimal expenditure until a downtown parking garage structure or some other alternative becomes available.

However, in order to complete this project, it is also necessary to install bike racks and additional lighting. This will require and additional $6,000 for project completion. Should the City Council approve this change order tonight, staff requests the Redevelopment Agency approve the funding of this change order in an amount not to exceed $6,000 so that the project may be completed.

FISCAL IMPACT
The cost of this project was accounted for in the approved CIP Budget 2002/03. This request for $6,000 is in addition to the original approved amount of $45,462.50 plus 10% contingency and, if approved, will be funded by the Redevelopment Agency’s Downtown Administrative Fund 301.
While the cost to construct and install the Second Street Parking Lot has been fully funded by the Redevelopment Agency, the annual operating/maintenance cost of approximately $6,000 will be funded by the City’s General Fund.

CITY OF BRENTWOOD AUTHORIZING THE FUNDING OF AN ADDITIONAL
$6,000 FOR BIKE RACKS AND ADDITIONAL LIGHTING TO COMPLETE
THE SECOND STREET PARKING LOT, CIP PROJECT 336-3135


WHEREAS, on May 28, 2002, the City Council of the City of Brentwood (“City”) approved and adopted the 2002/07 Capital Improvement Program for the City, of which the Second Street Parking Lot, CIP Project No. 336-3135 (“Public Improvements”), is a part; and

WHEREAS, on November 12, 2002, the City Council awarded a contract in the amount of $45,462.50 plus 10% contingency to Antioch Paving Company, Inc., to construct the Public Improvements; and

WHEREAS, on November 12, 2002, the Redevelopment Agency of the City of Brentwood (“Agency”) by its Resolution No. RA-63, approved the funding of the construction and installation of the Public Improvements in the amount of $45,462.50 and 10% contingency; and

WHEREAS, the Second Street Parking Lot has added an additional highly desired 52 parking spaces to the Downtown business area and reduced parking congestion around City Hall and the Downtown area; and

WHEREAS, in order to complete the Public Improvements, it is necessary to install bike racks and additional lighting for an additional amount not to exceed $6,000 (“Additional Public Improvements”); and

WHEREAS, the Agency desires to memorialize its expenditure approvals for redevelopment programs and activities that will facilitate commercial, retail and industrial development programs, public improvements and facilities programs.

NOW, THEREFORE BE IT RESOLVED by the Redevelopment Agency of the City of Brentwood as follows:

1. The Agency hereby finds and determines:

a. The Additional Public Improvements will be of benefit to the Redevelopment Project Area. This finding is based on the fact that the Additional Public Improvements will be located within the Project Area, will provide storage and parking for bicycles, which encourages an alternate mean of transportation that will promote reduced congestion, and will provide necessary lighting for security in the Second Street Parking Lot.

b. There is no other reasonable means of financing the Additional Public Improvements. This finding is based on the lack of sufficient funds in the capital improvement budget of the City to fund the Additional Public Improvements together with other urgently needed public improvements and facilities and the infeasibility of financing the Additional Public Improvements through an assessment district, community facilities district or other conventional method of financing public facilities.

c. The payment of funds for the Additional Public Improvements will assist in the elimination of one or more blighting conditions inside the Project Area, will improve parking facilities inside the Project Area by encouraging an alternate means of transportation and by providing the necessary security, and is consistent with the Implementation Plan. This finding is based on the following facts:

1. The Implementation Plan identifies as objectives for the five-year period from Fiscal Year 1999/00 through 2003/04 the following:

Improve transportation and parking facilities; enhance circulation within the Project Areas to reduce congestion and accommodate long-term growth and development patterns.

BE IT FURTHER RESOLVED that the Agency approves the funding of an amount not to exceed $6,000 for the Additional Public Improvements for the Second Street Parking Lot, CIP Project No. 336-3135.
