RECOMMENDATION
Adopt a Resolution reciting the facts of the General Municipal Election held on November 4, 2008, declaring the result and such other matters as provided by law.

PREVIOUS ACTION
At the City Council meeting of May 27, 2008, the City Council adopted Resolution 2008-122 requesting the Board of Supervisors of the County of Contra Costa to consolidate the November 4, 2008 General Municipal Election.

BACKGROUND
A General Municipal Election was held in the City on Tuesday, November 4, 2008. California Elections Code section 10263 states that upon the completion of the canvass of results by the County, prior to the installation of new officers, the City Council shall adopt a Resolution reciting the facts of the election and declare elected the persons for whom the highest number of votes were cast for each office.

As indicated in Exhibit A to the proposed Resolution the name of the person elected as Mayor for a full term of four years is Robert “Bob” Taylor, the names of the persons elected as Council Members for a full term of four years are Bob Brockman and Erick A. Stonebarger.

FISCAL IMPACT
The Contra Costa County Election Department estimated the total cost of the General Municipal Election would be approximately $1.75 per registered voter. The update number of registered voters in the City as of October 20, 2008, were 23,722 for a total estimated cost of $43,513. The election cost for the previous General Election Municipal Election held in November of 2006 was $0.89 per register voter while the estimate provided by the County was $2.50 per voter. The election costs are included in the in the Fiscal Year 2008/09 Operating Budget.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD, CALIFORNIA, RECITING THE FACT OF THE CONSOLIDATED GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 4, 2008 DECLARING THE RESULT AND SUCH OTHER MATTERS AS PROVIDED BY LAW


WHEREAS, a General Municipal Election was held and conducted in the City of Brentwood, California, Tuesday, November 4, 2008, as required by law; and

WHEREAS, notice of the election was given in the time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects the election was held and conducted and the votes were cast, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in general law cities; and

WHEREAS, pursuant to Resolution No. 2008-122 adopted May 27, 2008, the County Election Department canvassed the returns of the election and has certified the results, which results are attached and made a part hereof as “Exhibit A”.

NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF BRENTWOOD DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:

SECTION 1. That the whole number of ballots cast in the precincts except absent voter ballots was 9,654 that the whole number of absent voter ballots cast in the City was 10,963, making a total of 20, 615 ballots cast in the City.

SECTION 2. That the names of the persons voted for at the election for Members of the City Council were as follows:

Office of Mayor:
Robert “Bob” Taylor
Teresa J. Wooten

Office of Council Member:
Bob Brockman
Roger F. Short
Erick A. Stonebarger

SECTION 3. That the number of votes given at each precinct and the number of votes given in the City to each of the persons above named for the respective offices for which the persons were candidates, and the number of votes given at each precinct is as listed in “Exhibit A” attached.

SECTION 4. That the City Council does declare and determine that Robert “Bob” Taylor was elected as Mayor for the full term of four years, Bob Brockman and Erick A. Stonebarger were elected as members of the City Council for a full term of four years

SECTION 5. That the City Clerk shall enter on the records of the City Council of the City of Brentwood, a statement of the result of the election, showing: a. The whole number of votes cast in the City; b. The names of the persons voted for; c. For what office each person was voted for; d. The number of votes given at each precinct to each person and for and against each measure.

SECTION 6. That the City Clerk shall immediately make and deliver to each of the persons so elected a Certificate of Election signed by the City Clerk and authenticated; that the City Clerk shall also administer to each person elected the Oath of Office prescribed in the Constitution of the State of California and shall have them subscribe to it and file it in the office of the City Clerk. Each and all of the persons so elected shall then be inducted into the respective office to which they have been elected.

SECTION 7. That the City Clerk shall certify to the passage of this resolution and enter it into the book of original resolutions.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 9th day of December, 2008 by the following vote:
