Adopt a Resolution accepting public improvements for maintenance and reducing the Subdivision Improvement Securities for Deer Ridge Country Club, Village H-1-A Unit 2, Lafferty Homes, Subdivision No. 8545, located south of Foothill Drive and west of Concord Avenue.
On January 19, 1993, by Resolution No. 93-2, the Planning Commission approved Tentative Subdivision Map No. 7690, with conditions.
On October 12, 2004, by an Information Report, City Council was notified of the City Manager’s approval of the Final Map and Subdivision Improvement Agreement for Subdivision No. 8545 and acceptance of improvement securities.
This subdivision, located south of Foothill Drive and west of Concord Avenue, contains 35 single-family residential lots. All public improvements required by the Conditions of Approval for this subdivision have been constructed and inspected for conformance with the approved improvement plans including sewer, water and storm drain lines, sidewalk, paving, streetlights and fiber optics. Recently, the City has been notified that the Lafferty Homes (“Develooper”), has filed for bankruptcy. Upon receipt of this notification, staff has confirmed the active status of the bond policy to cover the twelve-month warranty period for the completed improvements.
As required by the Conditions of Approval and shown on the improvement plans, the Developer has installed the following improvement quantities: 475 Linear Feet (“LF”) of 8” sewer lines, 482 LF of 8” waterlines, 2,124 LF of 18” storm drain lines, 1,075 LF of curb and gutter, 1,096 LF of 5’ wide sidewalk, 508 LF of pavement, 3 streetlights and 1,613 LF of joint trench including fiber optic conduit. The necessary right-of-way offers of dedication and easements required for maintenance of the public improvements were offered to the City and accepted as a part of the Final Map. With the improvements now installed to support the new lots, it is the appropriate time to accept the improvements and begin the warranty period.
Upon acceptance of improvements the City will incur annual costs associated with necessary maintenance of streets, landscaping and utilities. Routine roadway maintenance will be funded by the General Fund and Measure “C” gas tax, with sewer and water maintenance funded through their respective enterprise funds. Landscaping and Lighting Assessment District (“LLD”) No. 99-5, has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING PUBLIC IMPROVEMENTS FOR MAINTENANCE AND REDUCING THE SUBDIVISION IMPROVEMENT SECURITIES FOR DEER RIDGE COUNTRY CLUB, VILLAGE H-1-A UNIT 2, LAFFERTY HOMES, SUBDIVISION NO. 8545, LOCATED SOUTH OF FOOTHILL DRIVE AND WEST OF CONCORD AVENUE.
WHEREAS, on January 19, 1993, by Resolution No. 93-2, the Planning Commission approved Tentative Subdivision Map No. 7690, with conditions; and
WHEREAS, on October 12, 2004, by an Information Report, City Council was notified of the City Manager’s approval of the Final Map and Subdivision Improvement Agreement for Subdivision No. 8545 and acceptance of improvement securities; and
WHEREAS, right-of-way offers of dedication and easements required for public improvements were offered upon the Final Map and accepted by the City at final map approval; and
WHEREAS, the required public improvements have been completed and are in conformance with the approved improvement plans.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood with respect to public improvements constructed by Lafferty Homes as a part of Subdivision No. 8545, Deer Ridge Village H-1-A, Unit 2 that:
1. All public improvements are hereby accepted for maintenance.
2. The Subdivision Performance and Payment Bonds are hereby reduced to 10% of their original value to guarantee against defects in material and workmanship and warrant the Subdivision Improvement Agreement obligations for a period of twelve months.
3. The Subdivision Performance and Payment Bonds are hereby authorized for release upon completion of the warranty period.
4. The City Clerk is hereby directed to file this Resolution with the Recorder of Contra Costa County.
