Subject/Title: Adopt a Resolution accepting the Zone 2.3 Booster Pump Station, Zone 2.3 Reservoir and Zone 3.3 Hydropneumatic Pump Station Master Planned Water Facilities, constructed as a part of the Vineyards at Marsh Creek, Subdivision No. 8796.

RECOMMENDATION
Adopt a Resolution accepting the Zone 2.3 Booster Pump Station, Zone 2.3 Reservoir and Zone 3.3 Hydropneumatic Pump Station Master Planned Water Facilities, constructed as a part of the Vineyards at Marsh Creek, Subdivision No. 8796.

PREVIOUS ACTION
On Marsh 16, 2004, by Resolution No. 04-20, Planning Commission approved Tentative Subdivision Map No. 8796, with conditions.

On April 27, 2004, by Ordinance No. 777, City Council approved the pre-zone for the Vineyards at Marsh Creek project.

On May 9, 2006, City Council was notified through an Informational Report of the City Manager’s approval of Final Subdivision Map No. 8796 and associated Subdivision Improvement Agreement.

BACKGROUND
Conditioned as a part of Tentative Subdivision Map No. 8796, Trilogy Vineyards/Shea Homes (“Developer”) constructed major water facilities. The Master Planned Water Improvements provide pumping and water storage facilities to service zone 2 and zone 3 water pressure zones within the Vineyards project and additional southwest areas of the City. The specific improvements constructed include: Zone 2 - 3.9 Million Gallon per Day (“MGD”) Booster Pump Station, Zone 2 – 4.0 MG Water Reservoir, Zone 3 - 4.0 MG Hydropneumatic Pump Station. These facilities are located at the southeast corner of Fairview Avenue and realigned Concord Avenue and the westerly side of the Vineyards project off of Vintage Circle. The facilities and associated appurtenances are complete and operational, and have been inspected for conformance with the approved improvement plans. The Developer has provided a Maintenance Bond to cover the twelve-month warranty period for the public improvements.

The necessary right-of-way offers of dedication and easements required for maintenance of the public improvements have been previously offered to, and accepted by, the City. With the improvements now installed, it is the appropriate time to accept the improvements and begin the warranty period.


FISCAL IMPACT
Upon acceptance of improvements, the City will incur annual costs associated with necessary maintenance of the water facilities to be funded by the Water Enterprise.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE ZONE 2.3 BOOSTER PUMP STATION, ZONE 2.3 RESERVOIR AND ZONE 3.3 HYDROPNEUMATIC PUMP STATION MASTER PLANNED WATER FACILITIES, CONSTRUCTED AS A PART OF THE VINEYARDS AT MARSH CREEK, SUBDIVISION NO. 8796.


WHEREAS, on Marsh 16, 2004, by Resolution No. 04-20, Planning Commission approved Tentative Subdivision Map No. 8796, with conditions; and

WHEREAS, on April 27, 2004, by Ordinance No. 777, City Council approved the pre-zone for the Vineyards at Marsh Creek project; and

WHEREAS, on May 9, 2006, City Council was notified through an Informational Report of the City Manager’s approval of Final Subdivision Map No. 8796 and associated Subdivision Improvement Agreement; and

WHEREAS, the required water improvements, have been completed and constructed in substantial conformance with the approved improvement plans; and

WHEREAS, Trilogy Vineyards/Shea Homes has posted a Maintenance Bond, guaranteeing materials and workmanship, for a period of one year following acceptance of improvements.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood with respect to Master Planned Water Facilities constructed by Trilogy Vineyards/Shea Homes as a part of Subdivision No. 8796 that:

1. Zone 2.3 Booster Pump Station, Zone 2.3 Reservoir and Zone 3.3 Hydropneumatic Pump Station public improvements are hereby accepted for maintenance.
2. The Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.
3. The City Clerk is hereby directed to file this Resolution with the Recorder of Contra Costa County.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 18th day of November 2008 by the following vote:
