RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager or designee to execute Amendment No. Two to Amend the Agreement for Professional Services with Bellecci & Associates for the John Muir Parkway Extension/Foothill Drive – Phase I, CIP Project No. 336-31640, in the amount of $31,446.80.

PREVIOUS ACTION
On June 13, 2006, by Resolution No. 2006-130, City Council approved and authorized the City Manager to execute an Agreement for Professional Services with Bellecci & Associates to provide design and construction support for the John Muir Parkway Extension/Foothill Drive – Phase I, CIP Project No. 336-31640, in the amount of $149,450, plus a 10% contingency, for a total amount of $164,395.

On December 11, 2007, by Resolution No. 2007-272, City Council approved and authorized the City Manager to execute Amendment No. One to Amend the Agreement for Professional Services with Bellecci & Associates for the John Muir Parkway Extension/Foothill Drive – Phase I, CIP Project No. 336-31640, in the amount of $36,394, plus a 10% contingency of $3,639.40, for a total increased amount of $40,033.40.

On May 27, 2008, by Resolution No. 2008-137, City Council adopted the City’s 2008/09 – 2012/13 Capital Improvement Program (“CIP”) Budget, which included the John Muir Parkway Extension/Foothill Drive – Phase I, CIP Project No. 336-31640.

BACKGROUND
The John Muir Parkway extension project (“Project”) will consist of constructing 2,000 feet of road from Ventura Drive to the Foothill Drive extension to provide north/south traffic circulation and access to surrounding properties. This roadway is necessary to replace the existing Concord Avenue due to Segment 3 of the State Route 4 Bypass. The City will proceed with the design and construction of the interim roadway consisting of two 14-foot lanes from Ventura Drive to Foothill Drive. The future development will be responsible for the widening of John Muir Parkway to its ultimate configuration.

The City’s portion of John Muir Parkway will include Phase I improvements as follows: one travel lane in each direction, median curb, and street lighting. Future development will complete the remaining roadway widening improvements.

Bellecci & Associates (“Consultant”) was chosen for this work due to the Consultant’s experience designing other segments of John Muir Parkway, and the preliminary design work already completed for this segment. The Consultant’s proposal under the original Agreement included the roadway design and geometrics, hydrology and storm drainage reports, final right-of-way documents, cost estimate, environmental permitting, technical assistance, and contract specifications. Further, the original Agreement included construction-related items such as field staking, construction support, and record drawings.

On December 11, 2007, Amendment No. One to the contract was approved for additional costs associated with the modification and realignment of the roadway. As the project has progressed it has become necessary to include additional tasks to finalize the project’s design. Amendment No. Two, for your approval this evening, includes the following additional tasks:

• Supplemental Hydrology and Hydraulics Analysis - necessary to finalize the design.

• Project coordination with Phase II and other agencies.

• Design, Details and Specifications for C-3 Clean Water Requirements and Detention Basin.

• Design, Details and Specifications for Wetland Mitigation.
The Agreement and Amendment No. One did not include the approved 10% contingency; therefore, Amendment No. Two also includes the $18,584.40 combined contingency amount.

Staff respectfully requests the approval of Amendment No. Two in order to complete the design and move forward with this project.

FISCAL IMPACT
The amount of Amendment No. Two is $31,446.80, in addition to the already approved contingency, bringing the total amount to $254,459.60, which is within the budgeted design costs of $435,000 in the adopted 2008/09 – 2012/13 CIP Budget, which includes the John Muir Parkway Extension/Foothill Drive – Phase I, CIP Project No. 336-31640.

TWO TO AMEND THE AGREEMENT FOR PROFESSIONAL SERVICES WITH BELLECCI & ASSOCIATES FOR THE JOHN MUIR PARKWAY EXTENSION/FOOTHILL DRIVE – PHASE I, CIP PROJECT NO. 336-31640, IN THE AMOUNT OF $31,446.80.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve and authorize the City Manager or designee to execute Amendment No. Two to Amend the Agreement for Professional Services with Bellecci & Associates for the John Muir Parkway Extension/Foothill Drive – Phase I, CIP Project No. 336-31640, in the amount of $31,446.80, plus an already approved contingency of $18,584.40.
