Subject/Title: Adopt Resolutions accepting all offers of dedication for rights-of-way, easements, parcels of land and other rights as shown on the Final Maps; accepting all public improvements for maintenance; accepting the Subdivision Maintenance Bonds; and releasing the Subdivision Improvement Securities for Deer Ridge Subdivision Nos. 8310 Phase II and 8493, located south of Balfour Road and west of Concord Avenue, developed by California Sun-Brentwood, LLC.

RECOMMENDATION
1) Adopt a Resolution accepting all offers of dedication for rights-of-way, easements, parcels of land and other rights as shown on the Final Map; accepting all public improvements for maintenance; accepting the Subdivision Maintenance Bonds; and releasing the Subdivision Improvement Securities for Deer Ridge Subdivision No. 8310 Phase II, located south of Balfour Road and west of Concord Avenue, developed by California Sun-Brentwood, LLC (“Developer”).

2) Adopt a Resolution accepting all offers of dedication for rights-of-way, easements, parcels of land and other rights as shown on the Final Map; accepting all public improvements for maintenance; accepting the Subdivision Maintenance Bonds; and releasing the Subdivision Improvement Securities for Subdivision No. 8493 Deer Ridge Village H-2, located south of Balfour Road and west of Concord Avenue, developed by California Sun-Brentwood, LLC (“Developer”).


PREVIOUS ACTION
On January 19, 1993, by Resolution No. 93-2, Planning Commission approved Tentative Subdivision Map No. 7690, with conditions.

On October 10, 2000, by Resolution No. 2169, City Council approved Final Subdivision Map No. 8310, accepting the improvement securities and approving the Subdivision Improvement Agreement.

On June 25, 2002, by Resolution No. 2585, City Council approved Final Subdivision Map No. 8493, accepting the improvement securities and approving the Subdivision Improvement Agreement

BACKGROUND
The Tentative Subdivision Map approval for this project, located south of Balfour Road and west of Concord Avenue, included the approval for a maximum of 1,031 residential lots and an 18-hole golf course. The Developer constructed the required off-site public improvements and master “backbone” infrastructure to support villages, or groups of lots, that were then further subdivided and mostly developed by other companies. The Phase II backbone and Subdivision No. 8493 improvements required by the Conditions of Approval for this project have been constructed and inspected for conformance with the approved improvement plans, including sewer, water and storm drain lines, sidewalk, paving, streetlights and fiber optics. As a part of this project, the Developer constructed the backbone roads providing looped access through the project including Foothill Drive, Spyglass Drive and St. Andrews Drive. In lieu of constructing the Foothill Drive extension to future John Muir Parkway, the Developer has posted $500,000 cash with the City for its completion with the City’s John Muir Parkway project. These provisions were included as a part of the three-party agreement between the City, Developer and Landgraf (adjacent property owner) previously approved by the City Council June 13, 2006. In addition, a Zone III hydropneumatic pump station has been constructed to service this southwest area of the City. CalSun also subdivided and constructed the public improvements for Subdivision No. 8493, known as in-tract Village H-2, containing 68 residential lots. The Developer has provided Maintenance Bonds to cover the twelve-month warranty period for all improvements.

As required by the Conditions of Approval and shown on the improvement plans, the Developer has installed the following improvement quantities: 11,018 linear feet (“LF”) of 8” sewer line, 11,575 LF of 8”-16” waterlines, 316,978 LF of various diameter storm drain lines, 18,450 LF of curb and gutter, 18,450 LF of 5’ sidewalk, 9,293 LF of pavement, 61 streetlights, 15,090 LF of joint trench including fiber optic conduit, 2 - 2million gallon per day Zone II water reservoirs and a 1.84 million gallon per day Zone III hydropneumatic water pump station.

When the Final Maps were approved by the City Council, the right-of-way offers of dedication were accepted subject to acceptance of improvements. The improvements are now installed to support the new villages and lots; therefore, it is the appropriate time to accept the improvements, rights-of-way and easements as offered on the Final Maps.

FISCAL IMPACT
Upon acceptance of improvements, the City will incur annual costs associated with necessary maintenance of streets, landscaping and utilities. Routine roadway maintenance will be funded by the General Fund and Measure “C” transportation sales tax, with sewer and water maintenance funded through their respective enterprise funds. Landscaping and Lighting Assessment District (“LLD”) No. 99-5, has been formed for this subdivision and will be responsible for the street lighting and landscaping maintenance.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING ALL OFFERS OF DEDICATION FOR RIGHTS-OF-WAY, EASEMENTS, PARCELS OF LAND AND OTHER RIGHTS AS SHOWN ON THE FINAL MAP; ACCEPTING ALL PUBLIC IMPROVEMENTS FOR MAINTENANCE; ACCEPTING THE SUBDIVISION MAINTENANCE BONDS; AND RELEASING THE SUBDIVISION IMPROVEMENT SECURITIES FOR DEER RIDGE SUBDIVISION NO. 8310 PHASE II, LOCATED SOUTH OF BALFOUR ROAD AND WEST OF CONCORD AVENUE, DEVELOPED BY CALIFORNIA SUN-BRENTWOOD, LLC.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood with respect to Subdivision No. 8310 Phase II, Deer Ridge, developed by California Sun-Brentwood, LLC, that:

1. All public improvements for maintenance are hereby accepted.
2. All offers of dedication for rights-of-way, easements, parcels of land and other rights intended for public use as shown on the Final Map are hereby accepted.
3. The Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.
4. The Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this Resolution.
5. The City Clerk is hereby directed to file this Resolution with the Recorder of Contra Costa County.
