Subject/Title: Adopt a Resolution approving and authorizing the City Manager or her designee to execute an amendment in the amount of $47,500 to the current professional services agreement with EcoLogic Engineering for groundwater evaluation studies to include groundwater well installation services to meet the requirements of the recently adopted Wastewater Treatment Plant Discharge Permit for a total agreement amount not to exceed $99,000.

RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager or her designee to execute an amendment in the amount of $47,500 to the current professional services agreement with EcoLogic Engineering for groundwater evaluation studies to include groundwater well installation services to meet the requirements of the recently adopted Wastewater Treatment Plant Discharge Permit for a total agreement amount not to exceed $99,000.

PREVIOUS ACTION
On June 26, 2007, by Resolution No. 2007-150, City Council adopted the 2007/08 – 2008/09 Operating Budget for the City of Brentwood.

On April 8, 2008, by Resolution No. 2008-79, City Council approved a professional services agreement with EcoLogic Engineering for groundwater evaluation studies in an amount not to exceed $51,500.

BACKGROUND
The City of Brentwood Wastewater Treatment Plant recently underwent a National Pollutant Discharge Elimination System (NPDES) permit renewal process with the Central Valley Regional Water Quality Control Board (CVRWQCB). The City’s new Wastewater Treatment Plant Discharge Permit was adopted at the January 25 2008, CVRWQCB meeting. Newly adopted permits require implementation of various special studies, work plans, and compliance schedules that have mandatory completion dates.

The CVRWQCB is requiring the City of Brentwood to conduct a groundwater study to demonstrate the Wastewater Treatment Plant is not contaminating the groundwater basin. This comes as a result of CVRWQCB policy which requires groundwater studies be completed in newly adopted permits in order to protect existing water resources in the State of California.

The Groundwater Evaluation Study requirements are specific and necessitate the services of a technical expert that is experienced in conducting groundwater studies including the installation and oversight of groundwater well sites. EcoLogic Consulting Engineers have the required technical expertise for these particular types of groundwater studies. The expertise is demonstrated by the fact that EcoLogic Engineering routinely performs groundwater studies and groundwater well installations of the same scope and purpose.

In the past, EcoLogic Engineering has provided design and construction inspection services for the City’s Wastewater Treatment Plant. In addition, during the 2006/07 fiscal year EcoLogic Engineering prepared the Wastewater Treatment Plant Expansion Study to provide options for any necessary changes or upgrades due to ongoing regulatory changes.

The Public Works Wastewater Division is currently under contract with EcoLogic Engineering for groundwater evaluation studies, which includes developing a groundwater monitoring work plan and groundwater quality characterization report as required by the newly adopted permit. The proposed agreement amendment will authorize EcoLogic to install three groundwater monitoring wells and to prepare a Groundwater Monitoring Well Installation Report for submittal to the CVRWQCB.

FISCAL IMPACT
The total fiscal impact of this agreement is $99,000. The amount of $47,500 required to perform the additional services will be added to the originally budgeted dollar amount of $10,000 for the 2008/09 fiscal year, bringing the total to be expended during the 2008/09 fiscal year to $57,500. These dollar amounts were included in the adopted Operating Budget for fiscal year 2008/09. The remaining $26,000 will be budgeted during the next two-year budget cycle commencing in 2009/10. The breakdown of cost per fiscal year is noted in Attachment 1. This professional services agreement amendment is in compliance with Council/Administrative Purchasing Policy 10-7 and does not amend the Council adopted 2008/09 Operating Budget.

ADOPT A RESOLUTION APPROVING AND AUTHORIZING THE CITY MANAGER OR HER DESIGNEE TO EXECUTE AN AMENDMENT IN THE AMOUNT OF $47,500 TO THE CURRENT PROFESSIONAL SERVICES AGREEMENT WITH ECOLOGIC ENGINEERING FOR GROUNDWATER EVALUATION STUDIES TO INCLUDE GROUNDWATER WELL INSTALLATION SERVICES TO MEET THE REQUIREMENTS OF THE RECENTLY ADOPTED WASTEWATER TREATMENT PLANT DISCHARGE PERMIT FOR A TOTAL AGREEMENT AMOUNT NOT TO EXCEED $99,000.

WHEREAS, the proposed agreement amendment will authorize EcoLogic to install three groundwater monitoring wells and to prepare a Groundwater Monitoring Well Installation Report for submittal to the CVRWQCB; and

WHEREAS, an amount of $57,500 has been budgeted in the 2008/09 Operating Budget; and

WHEREAS, the remaining $26,000 will be budgeted during the next two-year budget cycle commencing in fiscal year 2009/10 for a total agreement amount of $99,000; and

WHEREAS, this agreement amendment is in compliance with Council/Administrative Purchasing Policy 10-7.


NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve and authorize the City Manager or her designee to execute an amendment in the amount of $47,500 to the professional services agreement with EcoLogic Engineering for groundwater evaluation studies to include groundwater monitoring well installation and oversight to meet the requirements of the recently adopted Wastewater Treatment Plant Discharge Permit for a total agreement amount not to exceed $99,000.
