Subject/Title: Adopt a Resolution accepting dedications and improvements for Garin Ranch Subdivision No. 8609 (VTSM No. 7605), constructed by Signature Properties, located south of Chestnut Street and east of Garin Parkway.

RECOMMENDATION
Adopt a Resolution accepting all offers of dedication for rights-of-way, easements, parcels of land and other rights as shown on the Final Map; accepting all public improvements for maintenance; accepting the Subdivision Maintenance Bonds and releasing the Subdivision Improvement Securities for Garin Ranch Subdivision No. 8609 (VTSM No. 7605), constructed by Signature Properties, located south of Chestnut Street and east of Garin Parkway.

PREVIOUS ACTION
On March 17, 1992, the Planning Commission of the City of Brentwood adopted Resolution No. 92-04, approving Vesting Tentative Subdivision Map (“VTSM”) No. 7605, with conditions.

On May 14, 1994 and September 17, 1995, the Planning Commission amended Resolution No. 92-04, to modify the Conditions of Approval for VTSM No. 7605.

On July 22, 2003, by Resolution No. 2928, City Council approved Final Subdivision Map No. 8609, accepting the improvement securities and approving the Subdivision Improvement Agreement.

BACKGROUND
Subdivision No. 8609 (48 lots), located south of Chestnut Street, north of Redhaven Street and east of Garin Parkway is one of the last phases of the original Garin Ranch Tentative Subdivision Map (VTSM No. 7605) developed by Signature Properties (“Developer”). All public improvements required by the project’s Conditions of Approval have been constructed and inspected for conformance with the approved improvement plans including sewer, water and storm drain lines, sidewalk, paving, streetlights, fiber optic conduit and landscaping. As a part of this project, the Developer constructed the west side widening of Sellers Avenue and a non-potable water distribution mainline in Sellers Avenue. The Developer has provided Maintenance Bonds to cover the twelve-month warranty period for all improvements.

As required by the Conditions of Approval and shown on the improvement plans, the Developer has installed the following improvement quantities as a part of Subdivision No. 8609: 1,783 linear feet (“LF”) of 8” sewer lines, 1,851 LF of 8” waterlines, 382 LF of 18” storm drain lines, 2,556 LF of 5’ wide sidewalk, 2,035 LF of pavement, 3,677 LF of curb and gutter, 12 streetlights and 2,015 LF of fiber optic conduit.

When the Final Maps were approved by the City Council, the right-of-way offers of dedication were accepted subject to acceptance of improvements. The improvements are now installed to support the new lots; therefore, it is the appropriate time to accept the improvements, rights-of-way and easements as offered on the Final Map.

FISCAL IMPACT
Upon acceptance of improvements the City will incur annual costs associated with necessary maintenance of streets, landscaping and utilities. Routine roadway maintenance will be funded by the General Fund and Measure “C” transportation sales tax, with sewer and water maintenance funded through their respective enterprise funds. Landscaping and Lighting Assessment District (“LLD”) No. 95-8 has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING ALL OFFERS OF DEDICATION FOR RIGHTS-OF-WAY, EASEMENTS, PARCELS OF LAND AND OTHER RIGHTS AS SHOWN ON THE FINAL MAP; ACCEPTING ALL PUBLIC IMPROVEMENTS FOR MAINTENANCE; ACCEPTING THE SUBDIVISION MAINTENANCE BOND AND RELEASING THE SUBDIVISION IMPROVEMENT SECURITIES FOR GARIN RANCH SUBDIVISION NO. 8609 (VTSM NO. 7605), CONSTRUCTED BY SIGNATURE PROPERTIES, LOCATED SOUTH OF CHESTNUT STREET AND EAST OF GARIN PARKWAY.


WHEREAS, on March 17, 1992, the Planning Commission of the City of Brentwood adopted Resolution No. 92-04, approving Vesting Tentative Subdivision Map (“VTSM”) No. 7605, with conditions; and

WHEREAS, on May 14, 1994 and September 17, 1995, the Planning Commission amended Resolution No. 92-04, to modify the conditions of approval for VTSM No. 7605; and

WHEREAS, on July 22, 2003, by Resolution No. 2928, City Council approved Final Subdivision Map No. 8609, accepting the improvement securities and approving the Subdivision Improvement Agreement; and

WHEREAS, right-of-way offers of dedication and easements required for public improvements were offered to the City upon the final map subject to acceptance of improvements; and

WHEREAS, the required public improvements have been completed and constructed in substantial conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood with respect to Subdivision No. 8609, Garin Ranch, developed by Signature Properties that:

1. All public improvements for maintenance are hereby accepted.
2. All offers of dedication for rights-of-way, easements, parcels of land and other rights intended for public use as shown on the Final Map are hereby accepted.
3. The Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.
4. The Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this Resolution.
5. The City Clerk is hereby directed to file this Resolution with the Recorder of Contra Costa County.
