Adopt a Resolution accepting all off-site public improvements; accepting the Maintenance Bond; and releasing the Improvement Securities for Design Review (“DR”) 05-06, KFC/A&W Restaurant site located south of Lone Tree Way and west of Empire Avenue.
On June 20, 2007, by Resolution No. 06-61, Planning Commission approved DR No. 05-06, with conditions.
This project, located south of Lone Tree Way and west of Empire Avenue, was approved for a 3,621 square foot (“SF”) restaurant site. At this location, most surrounding public improvements to service the site were previously constructed. Modifications to those public improvements, such as driveway access and utility connections, have been constructed by the developer and inspected for conformance with the approved improvement plans and project Conditions of Approval.
The following public improvement quantities have been installed during construction of the project: 12 linear feet (“LF”) of 12” sewer line, 225 LF of 5’ sidewalk and 3,513 square feet (“SF”) of landscaping and irrigation. With the improvements now installed to the satisfaction of the City, it is the appropriate time to accept the improvements and begin the warranty period.
Most of the improvements associated with this project are privately owned and maintained; therefore, upon acceptance the City will incur only minimal annual costs associated with necessary maintenance of the public paving and concrete. Routine roadway maintenance will be funded by the General Fund and Measure “C” transportation sales tax, with sewer and water maintenance funded through their respective enterprise funds. Landscaping and Lighting Assessment District (“LLD”) No. 02-8 has been formed for this project and will be responsible for the landscape maintenance should the property owner not maintain the improvements to City standards.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING ALL OFF-SITE PUBLIC IMPROVEMENTS; ACCEPTING THE MAINTENANCE BOND; AND RELEASING THE IMPROVEMENT SECURITIES FOR DR 05-06, KFC/A&W RESTAURANT SITE LOCATED SOUTH OF LONE TREE WAY AND WEST OF EMPIRE AVENUE.
WHEREAS, on June 20, 2007, by Resolution No. 06-61, Planning Commission approved DR No. 05-06, with conditions; and
WHEREAS, the required improvements have been completed and constructed in substantial conformance with the approved improvement plans; and
WHEREAS, the developer has posted a warranty bond to guarantee the improvements for a period of one year following acceptance.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood with respect to Design Review No. 05-06, KFC/A&W Restaurant site that:
1. All off-site public improvements are hereby accepted for maintenance.
2. The Maintenance Bond is hereby accepted.
3. The Improvement Securities will be released within sixty (60) days of the passage of this Resolution.
4. The City Clerk is hereby directed to file this Resolution with the Recorder of Contra Costa County.
