RECOMMENDATION
Adopt a Resolution accepting the work performed by Granite Construction Company for the American Avenue Improvements, CIP Project No. 336-31681, and directing the City Clerk to file a Notice of Completion with the County Recorder.

PREVIOUS ACTION
On April 8, 2008, City Council accepted the findings of the American Avenue Task Force to construct short-term and mid-term solutions to relieve safety and congestion concerns to access Adams Middle School and Heritage High School.

On May 13, 2008, by Resolution No. 2008-109, City Council approved and authorized a Cost Sharing Agreement for improvements to American Avenue with the Liberty Union High School District (“LUHSD”) and the Brentwood Union School District (“BUSD”) for shared responsibilities of the improvements recommended by the American Avenue Task Force.

On May 27, 2008, by Resolution No. 2008-130, City Council approved the contract documents, awarded the bid and authorized the City Manager or designee to execute a construction contract and necessary documents for the American Avenue Improvements, CIP Project No. 336-31681, with Granite Construction Company, in the Base Bid amount of $110,995.00, plus Bid Alternate “A” in the amount of $42,775.00, plus Bid Alternate “B” in the amount of $53,708.00 for a bid total amount of $207,478.00.

On May 27, 2008, by Resolution No. 2008-137, City Council adopted the City’s 2008/09 – 2012/13 Capital Improvement Program, which included the American Avenue Improvements, CIP Project No. 336-31681.

BACKGROUND
Pursuant to the recommendations of the American Avenue Task Force, on May 27, 2008, City Council awarded a construction contract to Granite Construction Company for improvements on and adjacent to American Avenue, which are detailed below. This project was a cooperative effort between the Brentwood Union School District, City of Brentwood and Liberty Union High School District to improve pedestrian safety and the flow of traffic.

The American Avenue Improvements project added approximately 3,600 linear feet of a 10 foot wide pathway along the east side of American Avenue including six pedestrian-safe crosswalks. Also, an additional right turn lane into the Heritage High School student parking lot was added by re-striping the existing lines and reconstructing the median and landscape at the entrance of the student parking lot.

All the improvements are complete per the plans and specifications and Granite Construction Company has met its contractual obligation. Staff is making the recommendation that the work performed by Granite Construction Company be accepted and the Notice of Completion be filed with the County Clerk.

FISCAL IMPACT
The total contract amount for the work performed by Granite Construction Company for the American Avenue Improvements, CIP Project No. 336-31681, is as follows:

The final cost was approximately 14.7% under the City Council approved amount for this project and was budgeted in the adopted 2008/09-2012/13 Capital Improvement Program.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE WORK PERFORMED BY GRANITE CONSTRUCTION COMPANY FOR THE AMERICAN AVENUE IMPROVEMENTS, CIP PROJECT NO. 336-31681 AND DIRECTING THE CITY CLERK TO FILE A NOTICE OF COMPLETION WITH THE COUNTY RECORDER.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby accept the work performed by Granite Construction Company for the American Avenue Improvements, CIP Project No. 336-31681 and direct the City Clerk to file a Notice of Completion with the County Recorder.

NOTICE OF COMPLETION

NOTICE IS HEREBY GIVEN THAT:

THE CITY OF BRENTWOOD, a general law city, in the County of Contra Costa, State of California, did enter into an agreement on May 27, 2008, with Granite Construction Company for work performed for the American Avenue Improvements, CIP Project No. 336-31681.

The work described in the contract documents was to furnish all material, labor, and equipment necessary to complete said work located on American Avenue from Balfour Road south to Adams Middle School located at 401 American Avenue, Brentwood, CA 94513.

On the 9th day of September 2008, said contract, as a whole was completed and the work was accepted by the City Council of the City of Brentwood.

I hereby certify under penalty of perjury that the facts set forth in the foregoing Notice of Completion are true and correct.
