RECOMMENDATION
Adopt a Resolution Approving and Authorizing the City Manager or Designee to Execute an Agreement with Devcon Construction Incorporated for Construction Management Services as Relates to Construction of the Interim Library at the Annex Building, CIP #337-37194, in an Amount Not to Exceed $235,648.

PREVIOUS ACTION
On November 13, 2007, by Resolution No. 2007-269, City Council 1) endorsed the Civic Center Conceptual Plans; 2) endorsed the City Hall and Community Center Building Plans; 3) endorsed the History Walk concept as one of the Required Art Components of the Civic Center; and 4) directed staff to proceed with this project to design development.

On February 26, 2008, LPA, Inc. gave a presentation to City Council on milestones and critical decision points for the Civic Center project. The purpose was to inform City Council of when they would be required to make decisions that will affect the progress of the project.

On May 13, 2008, by Resolution No. 2008-115, City Council approved the Swinerton Management and Consulting contract for Construction Management services for the Civic Center Project.

On May 13, 2008, City Council continued the issue of consideration of a Resolution directing staff to Prepare Temporary Space for the Interim Library and Council Chambers at the Brentwood Education and Technology Center and directed staff to bring back a budget analysis for the costs associated with moving the library.

On May 27, 2008, by Resolution No. 2008-136, the City Council adopted the 2008/09-2012/13 Capital Improvement Program.


On June 10, 2008, City Council directed staff to pursue the temporary space for the interim library at the annex building and proceed with this project to design development.

BACKGROUND
The Library Annex Project is a very significant first step toward construction of the Civic Center project (“the Project”). The current Brentwood Library sits on the City Park property and needs to be relocated in order to move forward with the project. The plan is to relocate City staff and build the temporary library (Library Annex) in the eastern one-third (1/3) of the existing City Hall Annex (104 Oak Street). The Library Annex will be approximately 6,000 square feet. The other two-thirds (2/3) of the City Hall Annex will be occupied by City staff during the remodel of the Library Annex (118-120 Oak Street).

Staff is working with LPA, Inc., to design the temporary library and the design is expected to be completed by end of early September 2008. Construction could begin as soon as by October 2008. That date is subject to planning approvals and other circumstances. The Project schedule calls for construction of the library annex to be complete by late March 2008.

Due to the time constraints associated with this project, staff has decided to implement the Construction Manager at Risk (CM at Risk) model for this project. The CM at Risk model allows the City to bid and secure the necessary contracts for this project and then assign them to the CM to manage. In June 2008, the City issued an RFP to nine (9) full-service construction manager firms. On July 9, 2008, a pre-proposal conference was held at which five (5) construction manager firms attended. By the Request For Proposal due date of July 25, 2008, the City received two (2) responses: Devcon Construction Incorporated and R.L. Brown, both very reputable construction management firms.

The selection committee consisting of City staff and representatives from LPA, Inc., and Swinerton Management and Consulting, Inc., interviewed both firms on August 5, 2008. Devcon Construction Incorporated was selected based on the criteria outlined in the RFP (Exhibit A), which consisted of: experience; qualifications; time commitment; cost; project approach and responsiveness to RFP.

Devcon’s scope of work is outlined in the attached agreement (Exhibit B), but includes the following key strategies:

FISCAL IMPACT
The funds associated with this work are included in the adopted 2008/09-2012/13 Capital Improvement Program which includes the Library Relocation Project, CIP # 337-37914.

WHEREAS, the funds associated with this work are included in the adopted 2008/09-2012/13 Capital Improvement Program which includes the Library Relocation Project, CIP # 337-37914.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood hereby approves and authorizes the City Manager or designee to execute an agreement with Devcon Construction Incorporated for Construction Management Services as relates to construction of the Interim Library at the Annex Building in an amount not to exceed $235,648.
