Subject/Title: Adopt a Resolution accepting the work performed by Pacific Mechanical Corporation for the Sellers Avenue Sewer Lift Station Expansion and Upgrade, CIP Project No. 592-59150 and directing the City Clerk to file a Notice of Completion with the County Recorder.

RECOMMENDATION
Adopt a Resolution accepting the work performed by Pacific Mechanical Corporation for the Sellers Avenue Sewer Lift Station Expansion and Upgrade, CIP Project No. 592-59150 and directing the City Clerk to file a Notice of Completion with the County Recorder.

PREVIOUS ACTION
On August 14, 2007, by Resolution No. 2007-183, City Council approved the contract documents, awarded the bid and authorized the City Manager or designee to execute a construction contract and necessary documents for the Sellers Avenue Sewer Lift Station Expansion and Upgrade, CIP Project No. 592-59150, with Pacific Mechanical Corporation, in the amount of $613,700, plus a 10% contingency of $61,370, for a total amount of $675,070.

On May 27, 2008, by Resolution No. 2008-137, City Council adopted the City’s 2008/09 – 2012/13 Capital Improvement Program, which included the Sellers Avenue Sewer Lift Station Expansion and Upgrade, CIP Project No. 592-59150.

BACKGROUND
The Sellers Avenue Sewer Lift Station is located on the east side of Sellers Avenue, immediately north of the East Bay Municipal Utility District Mokelumne Aqueduct right-of-way, and south of Sunset Road. This project repaired the pump station structure, which included the rehabilitation of the wet well with an epoxy coating and replaced the existing pumps with new pumps to better control the flow of influent and provide redundancy. The rehabilitation of this lift station provided the ability for a portable generator hookup during loss of commercial power, the infrastructure necessary for future remote observation and control, and secondary spill containment.

All the improvements are complete per the plans and specifications and Pacific Mechanical Corporation has met its contractual obligation. Staff is making the recommendation that the work performed by Pacific Mechanical Corporation is accepted and the Notice of Completion be filed with the County Clerk.

FISCAL IMPACT
The total contract amount for the work performed by Pacific Mechanical Corporation for the Sellers Avenue Sewer Lift Station Expansion and Upgrade, CIP Project No. 592-59150 is as follows:

The final cost was approximately 6.81% under the City Council approved amount for this project and was budgeted in the adopted 2008/09-2012/13 Capital Improvement Program.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE WORK PERFORMED BY PACIFIC MECHANICAL CORPORATION FOR THE SELLERS AVENUE SEWER LIFT STATION EXPANSION AND UPGRADE, CIP PROJECT NO. 592-59150 AND DIRECTING THE CITY CLERK TO FILE A NOTICE OF COMPLETION WITH THE COUNTY RECORDER.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby accept the work performed by Pacific Mechanical Corporation for the Sellers Avenue Sewer Lift Station Expansion and Upgrade, CIP Project No. 592-59150 and direct the City Clerk to file a Notice of Completion with the County Recorder.

NOTICE OF COMPLETION

NOTICE IS HEREBY GIVEN THAT:

THE CITY OF BRENTWOOD, a general law city, in the County of Contra Costa, State of California, did, on the 14th day of April 2007, enter into an agreement with Pacific Mechanical Corporation for the Sellers Avenue Sewer Lift Station, CIP Project No. 592-59150.

The work described in the contract documents was to furnish all material, labor, and equipment necessary for the Sellers Avenue Sewer Lift Station on Sellers Avenue just south of Sunset Road in Brentwood, California.

On the 12th of August 2008, said contract, as a whole was completed and the work was accepted by the City Council of the City of Brentwood.

I hereby certify under penalty of perjury that the facts set forth in the foregoing Notice of Completion are true and correct.
