Subject/Title: Adopt a Resolution accepting off-site public utility improvements for maintenance; accepting the Maintenance Bond; and releasing the Improvement Securities for Subdivision No. 8506, Bridle Gate, located west of the State Route 4 Bypass, on both sides of the Sand Creek Road Extension developed by West Coast Home Builders.

RECOMMENDATION
Adopt a Resolution accepting off-site public utility improvements for maintenance; accepting the Maintenance Bond; and releasing the Improvement Securities for Subdivision No. 8506, Bridle Gate, located west of the State Route 4 Bypass, on both sides of the Sand Creek Road Extension developed by West Coast Home Builders (“Developer”).

PREVIOUS ACTION
On June 6, 2006, by Resolution No. 06-48, Planning Commission approved Tentative Subdivision Map No. 8506, with conditions.

On July 11, 2006, City Council adopted Ordinance No. 829 approving a Development Agreement (DA 04-02) for the Bridle Gate Project.

BACKGROUND
This subdivision, located west of the State Route 4 Bypass, on both sides of the Sand Creek Road Extension, being developed by West Coast Home Builders, consisting of approximately 134 acres will be subdivided into 166 single family residential lots and nine remainder parcels. The off-site sanitary sewer and water public improvements in Sand Creek Road from State Route 4 Bypass east to the Los Vaqueros Pipeline, to be completed concurrent with Sand Creek Road improvements across the State Route 4 Bypass as required by the project’s Conditions of Approval, have been constructed and inspected for conformance with the approved improvement plans.

As required by the Conditions of Approval and shown on the improvement plans, the Developer has installed the following improvement quantities: 810 Lineal Feet (“LF”) of 10” sewer lines, 4 sanitary sewer manholes, 857 LF of 16” waterlines and 821 LF of 12” non-potable waterlines. With the improvements now installed to the satisfaction of the City and prior to the next phase of construction on the State Route 4 Bypass, it is the appropriate time to accept the improvements and begin the warranty period.

FISCAL IMPACT
Upon acceptance of improvements the City will incur annual costs associated with necessary maintenance of public utilities. Sewer and water maintenance are funded through their respective enterprise funds.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING OFF-SITE PUBLIC UTILITY IMPROVEMENTS FOR MAINTENANCE; ACCEPTING THE MAINTENANCE BOND; AND RELEASING THE IMPROVEMENT SECURITIES FOR SUBDIVISION NO. 8506, BRIDLE GATE, LOCATED WEST OF THE STATE ROUTE 4 BYPASS, ON BOTH SIDES OF THE SAND CREEK ROAD EXTENSION, DEVELOPED BY WEST COAST HOME BUILDERS.


WHEREAS, On June 6, 2006, by Resolution No. 06-48, Planning Commission approved Tentative Subdivision Map No. 8506, with conditions; and

WHEREAS, On July 11, 2006, City Council adopted Ordinance No. 829 approving a Development Agreement (DA 04-02) and;

WHEREAS, the required off-site sanitary sewer and water public improvements, have been completed and constructed in substantial conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood with respect to Subdivision No. 8506, Bridle Gate, developed by West Coast Home Builders that:

1. Off-site sanitary sewer and water public improvements in Sand Creek Road from State Route 4 Bypass east to the Los Vaqueros Pipeline are hereby accepted for maintenance.
2. The Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.
3. The Performance and Payment Bonds will be released within sixty (60) days of the passage of this Resolution.
4. The City Clerk is hereby directed to file this Resolution with the Recorder of Contra Costa County.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting on the 12th day of August 2008 by the following vote:
