RECOMMENDATION
Adopt a Resolution authorizing the Executive Director to execute a Professional Services Agreement with Watry Design, Inc., in an amount not to exceed $112,105, plus a contingency of $10,711 for a total of $122,816, for design services associated with the proposed parking structure concept in the Downtown Parking Solutions CIP Project #337-37204.

PREVIOUS ACTION
On June 12, 2007, by Resolution No. 2007-126, City Council adopted the City’s 2007/08 – 2011/12 Capital Improvement Program (“CIP”), which included the Downtown Parking Structures.

On August 14, 2007, by Resolution No. 2007-179, the Council adopted a resolution approving an amendment to the Downtown Parking Structures CIP for the purpose of revising the description of the project from a single large structure to two smaller structures; identifying proposed strategic sites for the parking solutions; revising the estimated costs for the project; and accelerating the project timelines.

On May 27, 2008, by Resolution No. 2008-137, the Council adopted the 2008/09 – 2012/13 Capital Improvement Program (“CIP”), which included CIP Project # 337-37204 – Downtown Parking Solutions.

BACKGROUND
Watry Design, Inc. first started working for the City of Brentwood in June of 2003, when the City Council authorized a Professional Service Agreement with them for the development of a parking strategy analysis for Downtown Brentwood. The study that was conducted was used as guidance in the preparation of the Downtown Specific Plan.

As a result of the previous studies, an improvement plan is currently underway in the Downtown area. The plan includes the expansion of existing sidewalks, landscaping and the proposal of a retail opportunity site. In order for any retail business to be successful, it must include adequate parking for its customers that is not only clean and safe, but conveniently located. The retail opportunity site and parking structure is generally identified as the area bordered by Second Street to the East, Oak Street to the South, First Street to the West and Maple Street to the North.

Watry Design, Inc. will prepare and ultimately present a concept plan for a ground floor retail shell that has adequate parking for the retail site as well as additional parking for Downtown to accommodate future growth of retail and restaurant opportunities. Watry’s work includes mapping and CAD drawings of the site, structure configurations, internal navigation, parking geometrics, conceptual architectural elevations, probable construction cost estimates, and meetings with staff and the Land Use & Development Committee. A portion of Watry Design, Inc.’s scope of work includes working with a retail specialist that is assisting the Economic and Redevelopment Divisions in determining future retail uses in the Downtown. The Professional Services Agreement and Scope of Work are attached.


FISCAL IMPACT
The professional services agreement is in the amount of $112,105 ($107,105 of services and $5,000 of reimbursable expenses), plus a contingency of $10,711 (correlates to 10% of the services amount) for a total of $122,816. This agreement shall be funded entirely by Agency’s Administrative and Capital Projects Fund 301. The funds associated with this work are included in the adopted 2008/09 Agency budget and the adopted 2008/09-2012/13 Capital Improvement Program, which includes the Downtown Parking Solution, CIP Project No. 337-37204. No revenues are expected to offset this expenditure. A concurrent action on tonight’s agenda involves the transfer of funds from the Agency’s Administrative and Capital Projects Fund 301 to CIP 337-37204.

AGENCY RESOLUTION NO.

A RESOLUTION AUTHORIZING THE EXECUTIVE DIRECTOR TO EXECUTE A PROFESSIONAL SERVICES AGREEMENT WITH WATRY DESIGN, INC., IN AN AMOUNT NOT TO EXCEED $112,105, PLUS A CONTINGENCY OF $10,711 FOR A TOTAL OF $122,816, FOR DESIGN SERVICES ASSOCIATED WITH THE PROPOSED PARKING STRUCTURE CONCEPT IN THE DOWNTOWN PARKING SOLUTIONS CIP PROJECT #337-37204.

WHEREAS, the Redevelopment Agency of the City of Brentwood (“Agency”) adopted its annual 2008-09 Budget on June 24, 2008, by Resolution No. RDA-142; and

WHEREAS, the Agency desires to memorialize its expenditure approvals for redevelopment programs and activities that are funded by the Agency’s 2001 Tax Allocation Bond Proceeds that promote, establish, develop and support economic development, business and affordable housing opportunities and needed public infrastructure and improvements within the Merged Redevelopment Project Areas; and

WHEREAS, on June 12, 2007, by Resolution No. 2007-126, City Council adopted the City’s 2007/08 – 2011/12 Capital Improvement Program (“CIP”), which included the Downtown Parking Structures #337-37204 (“Project”); and

WHEREAS, May 27, 2008, by Resolution No. 2008-137, the Council adopted the 2008/09 – 2012/13 Capital Improvement Program (“CIP”), which included CIP Project # 337-37204 – Downtown Parking Solutions; and

WHEREAS, the Project, located within the Merged Redevelopment Project Areas, would address the parking demands required to continue to support the existing retail and restaurant vitality in Downtown as well as the new expected growth in the Downtown. Watry’s work includes mapping and CAD drawings of the site, structure configurations, internal navigation, parking geometrics, conceptual architectural elevations, probable construction cost estimates, and meetings with staff and the Land Use & Development Committee.

NOW, THEREFORE BE IT RESOLVED, the Redevelopment Agency of the City of Brentwood hereby approves and authorizes the Executive Director to execute a Professional Services Agreement with Watry Design, Inc., in an amount not to exceed $112,105, plus a contingency of $10,711 for a total of $122,816, for design services associated with the proposed parking structure concept in the Downtown Parking Solutions CIP Project #337-37204, in the form attached hereto, with minor changes as may be approved by the Executive Director in consultation with Agency Counsel.
