RECOMMENDATION
Adopt a Resolution approving a fee waiver request from Contra Costa County for $3,474.41 for the use of City facilities for the operation of the Contra Costa Immunization Program, Brentwood Public Library, California Offenders Program Services, Central Coast Ranch Athletic League and for $1,211.21 for Delta Community Services Inc. (DCSI) for July 1 – December 31, 2008.

PREVIOUS ACTION
August 22, 2000, City Council approved a partnership between the City of Brentwood and Delta Community Services, Inc (DCSI).

October 10, 2000, City Council approved the transfer of Delta Community Services, Inc. staff positions
into the City of Brentwood Parks and Recreation Department.

February 11, 2003, Delta Community Services, Inc. made a request for consideration of grant funds to represent the City as social service providers. Staff was directed to meet with Delta Community Services, Inc. members, along with Council Members Petrovich and Gutierrez and return with a recommendation.

July 8, 2003, City Council approved an 11-month grant for $2,000 per month for the provision of social services in fiscal year 2003/04.

May 25, 2004, City Council approved a renewal of a one-year grant request from DCSI for fiscal-year 2004/05.

June 14, 2005, City Council approved the 2005/07 Operating Budget which included funding for DCSI for fiscal years 2005/07.

On January 24, 2006, City Council approved Resolution No. 2006-18 amending the Council/Administrative Policy Manual to add a new Policy No. 10-12 related to the Policies and Procedures for Requests for Use of City Funds and repealed Resolution No. 99-99.

July 11, 2006, City Council approved Resolution No. 2006-162 the renewal of a one-year grant request from Delta Community Services, Inc. for $24,000 for fiscal year 2006/07 to provide social services representation to the community.
On September 12, 2006, City Council accepted the 2006/07 Annual Report of Fee Waivers and Donations.

On June 26, 2007, City Council by Resolution 2007-135 for the renewal of a two-year grant request from Contra Costa County for $18,867 for fiscal year 2007/08 and $19,452 for fiscal year 2008/09 and approved the fee waiver of $35,298 for use of City facilities for the operation of the County Senior Nutrition Program (Coco Café).

June 26, 2007, City Council adopted Resolution 2007-136 for the renewal of a two-year grant request from Delta Community Services, Inc. for $24,000 for fiscal year 2007/08 and $24,000 for fiscal year 2008/09 to provide social services representation for the community.

On August 28, 2007, City Council accepted the 2006/07 Annual Report of Fee Waiver and Donations.

On December 11, 2007, City Council adopted Resolution 2007-290 approving a fee waiver request from Contra Costa County for $4,046.97 for fiscal year 2007/08 for the use of City facilities for the operation of the Contra Costa Immunization Program, Brentwood Public Library, California Offenders Program Services, and Central Coast Ranch Athletic League.

December 11, 2007, City Council adopted Resolution 2007-289 approving a facility fee waiver request from Delta Community Services, Inc. for $2,444.31 for fiscal year 2007/08 to provide Delta Community Services, Inc. staff meetings, Hi-Cap Insurance Counseling and fundraisers.

On January 8, 2008, City Council approved Resolution 2008-01, an additional Fee Waiver and/or Fee Reduction/Donation request from Delta Community Services, Inc. for $120.65 for fiscal year 2007/08 for Hi-Cap Insurance Counseling to provide an additional hour of service per month.

On March 25, 2008, City Council approved Resolution 2008-066 for a fee waiver request in the amount of $287.77 for Central Coast Ranch League for fiscal year 2007/08 for the use of the City facilities for the operation of the Central Coast Ranch Athletic League.

BACKGROUND
When City Council passed Resolution No. 2006-18 on January 24, 2006, it established procedures and criteria to be used for fee waivers and/or donations. It also established that an annual report will be provided to the City Council of fee waivers or reductions and/or donations.

Contra Costa County Immunization Program has provided flu immunization services to East Contra Costa seniors and special needs population since October 2000. The Contra Costa County Public Health Flu Shot Clinic is requesting a fee waiver for the Public Health Flu Shot Clinic to be held on Thursday, October 16, 2008 at the Brentwood Community Center in the amount of $187.74. After review of the application, staff feels this request meets the criteria outlined in the policy and therefore recommends approval of this fee waiver.

The Brentwood Public Library uses the Brentwood Community Center Multi-Purpose and Blue Room to host children, teen and adult programs. These Library programs have been ongoing since the library opened in 1979. These programs generally benefit elementary, middle and high school students, as well as adults. There are twelve program dates from July 1, 2008-December 31, 2008 in the amount of $1,301.93. After review of the application, staff feels this request meets the criteria outlined in the policy and therefore recommends approval of this fee waiver.

California Offender Program Services (COPS) has been providing educational programs to probation, school district, police and counseling agencies since 1990. They have worked in Contra Costa County since 1991. The program is designed to keep juveniles from getting further into the probation/police system. They have a 90% success rate. The City of Brentwood has provided use of the Women’s Club facility for this county program to use. Use of the Women’s Club facility has been ongoing since February 2002. The COPS is requesting a fee waiver in the amount of $942.57 for their program from July 26, 2008-November 22, 2008. After review of the application, staff feels this request meets the criteria outlined in the policy and therefore recommends approval of this fee waiver.

The Central Coast Ranch Athletic League is a Contra Costa County program which serves as a rehabilitation program for juveniles. The program itself offers a variety of different recreational opportunities and the softball league is one of them. The league offers a pre and post season softball tournament each year. Approximately 120 juveniles will participant in each of the tournaments. The Central Coast Ranch Athletic League is requesting a fee waiver for their league play on September 4, 2008 and June 4, 2009 in the amount of $1,042.17. After review of the application, staff feels this request meets the criteria outlined in the policy and therefore recommends approval of this fee waiver.

Delta Community Services, Inc. (DCSI) has continued as an independent organization, working in the community on a variety of social service programs. As a result of City Council action on July 8, 2003, DCSI was given $2,000 per month for fiscal year 2003/04, and was also provided with desk space, a phone and rent-free space, with limited support by the administrative staff of the Parks and Recreation Department for the provision of social services for the community.

The Director of Parks and Recreation previously waived the fee for use of office space ($1,260) telephone ($300) and desk/work space ($1,500) for a total of $3,060 for fiscal year 2008/09. Those expenses are contained within the Parks and Recreation budget. City Council approved $24,000 for one staff person for social services for DCSI for fiscal year 2008/09 per the Council/Administrative Policy 10-12.

DCSI has submitted an additional fee waiver application in the amount of $1,211.21 for July 1, 2008-December 31, 2008 to provide DCSI staff meetings, Hi-Cap Insurance Counseling, and fundraising events. After review of the application, staff feels this request meets the criteria outlined in the policy and therefore recommends approval of this fee waiver.

FISCAL IMPACT
Approval of the fee waivers for Contra Costa County Programs will result in the City not receiving $3,474.41 for use of the facilities .

Approval of the fee waiver for DCSI for staff meetings, Hi-Cap Insurance Counseling, and fundraising events will result in the City not receiving $1,211.21 for use of the facilities.

If approved, for Fiscal Year 2008/09 the City will have waived a total of $30,461.41 to support Contra Costa County Programs and it has contributed a total of $28,271.21 to support Delta Community Services, Inc.

WHEREAS, on January 24, 2006, the City Council approved Resolution No. 2006-18 amending the Council/Administrative Policy Manual to add a new Policy No. 10-12 related to the Policies and Procedures for Requests for Use of City Funds and repealed Resolution No. 99-99; and

WHEREAS, on September 12, 2006, the City Council accepted the 2005/06 Annual Report of Fee Waivers and Donations; and

WHEREAS, on August 28, 2007, the City Council accepted the 2006/07 Annual Report of Fee Waiver and Donations; and

WHEREAS, on June 26, 2007 City Council by Resolution 2007-135 approved the renewal of a two year grant request from Contra Costa County for $18,867 for fiscal year 2007/08 and $19,452 for fiscal year 2008/09 and approved the fee waiver of $35,298 for use of City Facilities for the operation of the County Senior Nutrition Program (Coco Café); and

WHEREAS, on January 8, 2008, City Council by Resolution 2008-01 approved an additional fee waiver and/or fee reduction/donation request from Delta Community Services, Inc. for $120.65 for fiscal year 2007/08 for Hi-Cap Insurance Counseling to provide an additional hour of service per month; and

WHEREAS, on March 25, 2008, City Council by Resolution 2008-066 approved a fee waiver request in the amount of $287.77 for Central Coast Ranch Athletic League for fiscal year 2007/08 for the use of the City facilities for the operation of the Central Coast Ranch Athletic League; and

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Brentwood approves the additional fee waiver request from Contra Costa County in the amount of $3,474.41, for the use of City Facilities for the operation of Contra Costa Immunization Program, Brentwood Public Library, California Offenders Program Services, Central Coast Ranch Athletic League and for Delta Community Services, Inc. in the amount of $1,211.21 for meetings, fundraisers and Hi-Cap programs for July 1 – December 31, 2008.
