Subject/Title: Adopt a Resolution accepting the work performed by Top Grade Construction, Inc. for Phase II (Street) of Walnut Boulevard Widening, CIP Project No. 336-30560, and directing the City Clerk to File a Notice of Completion with the County Recorder.

RECOMMENDATION
Adopt a Resolution accepting the work performed by Top Grade Construction, Inc. for Phase II (Street) of Walnut Boulevard Widening, CIP Project No. 336-30560, and directing the City Clerk to File a Notice of Completion with the County Recorder.

PREVIOUS ACTION
On March 28, 2006, by Resolution No. 2006-52, City Council approved the Contract Documents and authorized the City Manager to execute a Construction Contract for the Walnut Boulevard Widening (Utilities), CIP Project No. 336-30560, to K.J. Woods Construction, Inc. in the amount of $1,984,000, plus a 10% contingency, for a total amount of $2,182,400.

On April 10, 2007, by Resolution No. 2007-62, City Council approved and authorized the City Manager or designee to execute a Construction Contract and necessary documents for the Walnut Boulevard Widening – Phase II (Street), CIP Project No. 336-30560, to Top Grade Construction, Inc. in the amount of $1,794,794, plus a 10% contingency, for a total amount of $1,974,273.40.

On June 12, 2007, by Resolution No. 2007-126, City Council adopted the City’s 2007/08 – 2011/12 Capital Improvement Program (“CIP”), which included the Walnut Boulevard Widening, CIP Project No. 336-30560.

On December 11, 2007, by Resolution No. 2007-286 City Council amended City Council’s approval of a 10% contingency with Top Grade Construction, Inc. for Phase II (Street) of Walnut Boulevard Widening, CIP Project No. 336-30560, to an 18% contingency for an additional amount of $143,483.52, using savings from Phase I (Utilities).

BACKGROUND
Walnut Boulevard Widening (from Balfour Road to Oak Street) entailed two phases of work. Phase I (Utilities) provided the installation of storm drain, water, street lighting, fiber and signal interconnect conduit, and overhead power, phone and cable conversion to underground. Phase II (Street) widened the roadway to two lanes in each direction and installed a median island with landscaping in the easterly parkway.

Phase I (Utilities) of the project is complete and was accepted by City Council on November 13, 2007. Phase II had some additional work; such as, additional sidewalk, pavement thickness revision due to shallow Chevron pipeline at Oak Street, grinding and overlaying Walnut Boulevard from Oak Street to Dainty Avenue, installation of signal interconnect conduit and fiber optic conduits from Oak Street to Dainty Avenue, additional signal conduits installed for the future signal at Walnut Boulevard/McClarren Road and the addition of video detection at Walnut Boulevard/Oak Street and Walnut Boulevard/Balfour Road.

With all of these additional work items, unknowns and obstacles encountered on this project, staff and the contractor were able to work diligently to bring this project to a satisfactory completion and within the budget approved by City Council.

All the improvements are complete per the plans and specifications and Top Grade Construction, Inc. has met its contractual obligation. Staff is making the recommendation that the work performed by Top Grade Construction, Inc. be accepted and the Notice of Completion be filed with the County Clerk.

FISCAL IMPACT
The total contract amount for the work performed by Top Grade Construction, Inc. for Walnut Boulevard Widening Phase II (Street), CIP Project No. 336-30560, is as follows:

The final cost came within 4% under the City Council approved amount for this project and was budgeted in the 2007/08 – 2011/2012 Capital Improvement Program.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE WORK PERFORMED BY TOP GRADE CONSTRUCTION, INC. FOR PHASE II (STREET) OF WALNUT BOULEVARD WIDENING, CIP PROJECT NO. 336-30560, AND DIRECTING THE CITY CLERK TO FILE A NOTICE OF COMPLETION WITH THE COUNTY RECORDER.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby accept the work performed by Top Grade Construction, Inc. for Phase II (Street) of Walnut Boulevard Widening, CIP Project No. 336-30560, and directs the City Clerk to file a Notice of Completion with the County Recorder.

NOTICE OF COMPLETION


NOTICE IS HEREBY GIVEN THAT:

THE CITY OF BRENTWOOD, a general law city, in the County of Contra Costa, State of California, did, on the 10th day of April 2007, enter into an agreement with Top Grade Construction, Inc. for Phase II (Streets) of Walnut Boulevard Widening, CIP Project No. 336-30560.

The work described in the contract documents was to furnish all material, labor, and equipment necessary for Walnut Boulevard Widening from the Balfour Road to Oak Street in Brentwood, California.

On the 22nd of July 2008, said contract, as a whole was completed and the work was accepted by the City Council of the City of Brentwood.

I hereby certify under penalty of perjury that the facts set forth in the foregoing Notice of Completion are true and correct.
