RECOMMENDATION
Adopt a Resolution repealing Resolution No. 2008-121, in its entirety and calling and giving notice of the holding of a General Municipal Election to be held on Tuesday, November 4, 2008, for the election of Mayor and two [2] Council Members as required by the provisions of the laws of the State of California relating to general law cities, and directing the City Clerk to take certain actions as required by State law.

PREVIOUS ACTION
On May 27, 2008, the City Council adopted Resolution 2008-121, calling and giving notice of the holding of a General Municipal Election to be held on Tuesday, November 4, 2008, for the election of Mayor and two [2] Council Members as required by the provisions of the laws of the State of California relating to general law cities, and directing the City Clerk to take certain actions as required by State law.

BACKGROUND
Subsequent to the adoption of Resolution 2008-121, the Contra Costa County Elections Department requested that the City adopt a resolution regarding how tie votes will be decided. Elections Code 15651 provides that tie votes shall be determined by lots or shall be determined by a runoff election.

Staff is recommending with this resolution that tie votes be decided by lots. This recommendation is based primarily on the fact that a run-off election would be a stand-alone election and could cost $7.25 per registered voter for a total amount of $145,688.75. In addition, an informal survey of other cities indicate that they require tie votes be determined by lots. The remainder of the attached resolution is identical to Resolution No. 2008-121 adopted by the City Council on May 27, 2008.

FISCAL IMPACT
The Contra Costa County Election Department estimates the total cost of the General Municipal Election will be approximately $1.75 per registered voter. As of May 1, 2008, there were approximately 20,100 registered voters in the City of Brentwood; therefore the estimated cost is

approximately $35,175. The County has provided a cost estimate of $778 per candidate for the printing of the statements, an advance deposit of this amount will be required by each candidate wishing to have their candidate statement printed. The expense for the November 2008 election was budgeted for in the existing 2008/09 Operating Budget.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD, CALIFORNIA, REPEALING RESOLUTION NO. 2008-121, IN ITS ENTIRETY AND CALLING AND GIVING NOTICE OF THE HOLDING OF A GENERAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, NOVEMBER 4, 2008, FOR THE ELECTION OF MAYOR AND TWO [2] COUNCILMEMBERS AS REQURIED BY THE PROVISIONS OF THE LAWS OF THE STATE OF CALIFORNIA RELATING TO GENERAL LAW CITIES, AND DIRECTING THE CITY CLERK TO TAKES CERTAIN ACTIONS AS REQUIRED BY STATE LAW

WHEREAS, under the provisions of the laws relating to general law cities in the State of California a General Municipal Election shall be held on November 4, 2008, for the elections of Municipal Officers; and

WHEREAS, the term for two Council Members and the office of Mayor will expire in November, 2008; and

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does declare, determine, and order as follows:
1. That pursuant to the requirements of the laws of the State of California there is called and ordered to be held in the City of Brentwood, California, on Tuesday, November 4, 2008, for the election of a Mayor to a four year term, and two Council Members to a four year term.
2. That the ballots to be used at the election shall be in form and content as required by law.
3. That the City Clerk is authorized, instructed and shall be directed to procure and furnish all official ballots, notices, printed matter and all supplies, equipment and paraphernalia that may be necessary in order to properly and lawfully conduct the election.
4. That the polls for the election shall be open at seven o’clock a.m. of the day of the election and shall remain open continuously from that time until 8:00 p.m. of the same day when the polls shall be closed, except as provide in § 14401 of the Elections Code of the State of California.
5. That in all particulars not recited in this resolution, the election shall be held and conducted as provided by law for holding municipal elections.
6. That notice of the time and place of holding the election is given and the City Clerk is authorized, instructed, and directed to give further or additional notice of the election, in time, form and manner as required by law.
7. That the City of Brentwood recognizes that additional costs will be incurred by the County by reason of this consolidation and agrees to reimburse the County for direct costs incurred by the County associated with this election.
8. That should a tie vote occur from the election, the tie vote shall be determined by lots.
9. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
10. Repeal Resolution 2008-121.
