RECOMMENDATION
Adopt a resolution in support of Assembly Bill 2168 as amended on June 10, 2008 and as recommended by the Agricultural Enterprise Committee.

BACKGROUND
Assemblymember Dave Jones of the 9th Assembly District introduced AB 2168, a bill titled “Farm Stands: Direct Marketing: Retail Food,” on February 20, 2008. A copy of the current bill language is attached as Exhibit A to the resolution.

To summarize some of its highlights, the bill provides for the expansion of certain farm stand activities, such as the sale of pre-packaged food products (i.e. bottled water and soft drinks) and authorizes local farm stands to sell its products to entities that subsequently sell produce directly to end users, such as restaurants. Additionally, the bill adds farm stands to the list of food facilities in the Health and Safety Code as it pertains to the California Retail Food Code (CRFC), thus requiring farm stands to conform to the same standards as farmers’ market but exempting them from broader health and safety standards.

A summary of the bill was provided to the Agricultural Enterprise Committee at its June 9, 2008 meeting. The Committee has recommended support of the bill in its current form.

This bill has received support from the Brentwood Chamber of Commerce, Harvest Time, the Contra Costa Agricultural Advisory Task Force, the Board of Supervisors, Pacific Coast Farmers’ Market Association (operator of the Brentwood Farmers’ Market), among several other groups and individuals. The bill has no opposition on record.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD SUPPORTING ASSEMBLY BILL 2168 AS AMENDED ON JUNE 10, 2008 AND AS RECOMMENDED BY THE AGRICULTURAL ENTERPRISE COMMITTEE
