Subject/Title: Adopt a Resolution approving and authorizing the City Manager or designee to execute Amendment No. Six to the Professional Services Agreement with William J. Silva, P.E., for Engineering Support Services to extend the contract termination date from June 30, 2008, to June 30, 2009.

RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager or designee to execute Amendment No. Six to the Professional Services Agreement with William J. Silva, P.E., for Engineering Support Services to extend the contract termination date from June 30, 2008, to June 30, 2009.

PREVIOUS ACTION
On August 19, 2004, the City of Brentwood entered into a Professional Services Agreement with William J. Silva, P.E., to obtain Transportation Engineering Services on an as-needed basis through December 31, 2004.

On December 20, 2004, Amendment No. One to the Professional Services Agreement with William J. Silva, P.E., was entered into to extend the contract termination date until June 30, 2005, for Transportation Engineering Services on an as-needed basis.

On June 14, 2005, by Resolution No. 2005-136, City Council authorized the City Manager to execute Amendment No. Two to the Professional Services Agreement with William J. Silva, P.E., to extend the contract termination date until December 31, 2005, and increased the fee of $75.00 per hour to $80.00 per hour, for Transportation Engineering Services on an as-needed basis.

On December 13, 2005, by Resolution No. 2005-290, City Council authorized the City Manager to execute Amendment No. Three to the Professional Services Agreement with William J. Silva, P.E., to extend the contract termination date until June 30, 2006, to provide Transportation Engineering Services on an as-needed basis.

On June 27, 2006, by Resolution No. 2006-152, City Council authorized the City Manager to execute Amendment No. Four to the Professional Services Agreement with William J. Silva, P.E. altering the Agreement’s scope of work to provide Development Engineering Services (in lieu of Transportation Engineering Services), increase the fee of $80.00 per hour to $90.00 per hour, for the Engineering Division of the Public Works Department including, but not limited to, plan check and other related services, for the City of Brentwood.

On June 26, 2007, by Resolution No. 2007-146, City Council ratified, approved and authorized the City Manager to execute Amendment No. Five to the Professional Services Agreement with William J. Silva, P.E., for Engineering Support Services.


BACKGROUND
William J. Silva, P.E., has provided consultant engineering support services to the Engineering Division of the Public Works Department since August of 2004. He has provided traffic engineering support services through February of 2006 while the City was recruiting for a Traffic Engineering Manager. Subsequently, he has provided engineering support services to the Development Division while the City was recruiting for a Development Engineering Manager. More recently, with limited staff in our CIP section, he has provided project management and coordination services for review of plans prepared for construction of capital improvement program projects, and assisted with the construction management of projects for which contracts are awarded for construction.

Staff has been very satisfied with William J. Silva’s previous professional work performance. His experience with the City’s street system, water and wastewater systems and storm drainage facilities, as well as his expertise in managing capital improvement program construction projects, has been extremely beneficial to the City.

His current contract expires on June 30, 2008, there are sufficient funds already encumbered for his continued service. Therefore, staff is respectfully requesting a contract time extension through June 30, 2009, which would enable Mr. Silva to continue assisting staff and allow the completion of several current projects.

FISCAL IMPACT
There is no fiscal impact associated with this specific action. This Amendment is for a time extension only. The costs associated with the reminder of this Agreement have been budgeted in the 2007/08 - 2008/09 Operating Budget.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AND AUTHORIZING THE CITY MANAGER OR DESIGNEE TO EXECUTE AMENDMENT NO. SIX TO THE PROFESSIONAL SERVICES AGREEMENT WITH WILLIAM J. SILVA, P.E., FOR ENGINEERING SUPPORT SERVICES TO EXTEND THE CONTRACT TERMINATION DATE FROM JUNE 30, 2008, TO JUNE 30, 2009.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve and authorize the City Manager or designee to execute Amendment No. Six to the Professional Services Agreement with William J. Silva, P.E., for Engineering Support Services to extend the contract termination date from June 30, 2008, to June 30, 2009.
