Subject/Title: Adopt a Resolution accepting off-site non-potable waterline improvements constructed by Brentwood Specialty Center, LLC as a part of the Streets of Brentwood, Design Review No. 06-08, located at the northwest corner of Sand Creek Road and Shady Willow Lane.

RECOMMENDATION
Adopt a Resolution accepting off-site non-potable waterline improvements constructed by Brentwood Specialty Center, LLC as a part of the Streets of Brentwood, Design Review (“DR”) No. 06-08, located at the northwest corner of Sand Creek Road and Shady Willow Lane.

PREVIOUS ACTION
On October 3, 2006, by Resolution No. 06-99, Planning Commission approved DR No. 06-08, with conditions.

On February 12, 2008, by Resolution No. 2008-29, City Council approved a Reimbursement Agreement with Brentwood Specialty Center, LLC for costs associated with Master Plan Facility Improvements.

BACKGROUND
This project was approved for a 460,000 Square Foot (“SF”) Commercial Center. As part of the project the developer constructed an off-site non-potable water distribution line in Shady Willow Lane and Sand Creek Road. This line is a master planned facility and part of the City’s Non-potable Water Master Plan that has been developed for water conservation efforts. As a master planned facility, the line is reimbursable. The improvements include 1,200 LF of 12” non-potable water main and appurtenant facilities that have been constructed by the developer and inspected by the City for conformance with the approved improvement plans. With work complete to City satisfaction, it is the appropriate time to accept the improvements into the City’s non-potable water distribution system and begin the one year warranty period.

FISCAL IMPACT
Upon acceptance, the City will incur annual costs associated with routine operations and maintenance that will be funded through water enterprise funds.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING OFF-SITE NON-POTABLE WATERLINE IMPROVEMENTS CONSTRUCTED BY BRENTWOOD SPECIALTY CENTER, LLC AS A PART OF THE STREETS OF BRENTWOOD, DESIGN REVIEW NO. 06-08, LOCATED AT THE NORTHWEST CORNER OF SAND CREEK ROAD AND SHADY WILLOW LANE.


WHEREAS, on October 3, 2006, by Resolution No. 06-99, Planning Commission approved DR No. 06-08, with conditions, with conditions; and

WHEREAS, on February 12, 2008, by Resolution No. 2008-29, City Council approved a Reimbursement Agreement with Brentwood Specialty Center, LLC for costs associated with Master Plan Facility Improvements; and

WHEREAS, the required improvements have been completed and constructed in substantial conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood with respect to Design Review No. 06-08, the Streets of Brentwood, that:

1. Off-site non-potable waterline improvements in Shady Willow Lane and Sand Creek Road east of Shady Willow Lane are hereby accepted for maintenance.
2. Payment for the work is hereby authorized per the Reimbursement Agreement with Brentwood Specialty Center, LLC for costs associated with Master Plan Facility Improvements.
3. The City Clerk is hereby directed to file this Resolution with the Recorder of Contra Costa County.
