Subject/Title: Adopt a Resolution approving a Grant Deed to the State of California for roadway along Highway 4 required as part of the Brentwood Boulevard Widening - Central, CIP Project No. 336-31490 and authorizing execution of said Grant Deed.

RECOMMENDATION
Adopt a Resolution approving a Grant Deed to the State of California and authorizing the City Manager or designee to execute said Grant Deed, hereby conveying real property to the State of California (“Caltrans”), identified as a portion of roadway parallel to Highway 4 (“Brentwood Boulevard") on the east side and west side, generally located between Central Boulevard and Village Drive and any other documents necessary to complete the transaction.

PREVIOUS ACTION
On June 12, 2007, by Resolution No. 2007-126, City Council adopted the City’s 2007/08 - 20011/12 Capital Improvement Program (“CIP”) that included the Brentwood Boulevard Widening - Central, CIP Project No. 336-31490.

On March 11, 2008, by Resolution No. 2008-50, City Council accepted the work performed by Ghilotti Bros., Inc. for the Brentwood Boulevard Widening – Central, CIP Project No. 336-31490, and directed the City Clerk to file a Notice of Completion with the County Recorder.

BACKGROUND
This project continued the widening along Brentwood Boulevard between Central Boulevard and Village Drive, which improved traffic flow and provided a smooth progression along Brentwood Boulevard. The project consisted of providing two lanes in each direction (approximately 800 feet), center double left hand turn lane median, curbs, gutters, sidewalks, bike lanes, streetlights and landscaping on each side of the street.

As part of the permitting process Caltrans requires all right-of-way (travel roadway) necessary for the widening, be conveyed to the State, since this is a State Highway. Now that this project is complete, Caltrans is ready to move forward with the customary transfer process. Without completing the process the current roadway is partially owned by the City; therefore, this should be considered a housekeeping item to comply with Caltrans’ permit requirements.

FISCAL IMPACT
There is no fiscal impact in completing the right-of-way transfer process.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING A GRANT DEED TO THE STATE OF CALIFORNIA AND AUTHORIZING THE CITY MANAGER OR DESIGNEE TO EXECUTE SAID GRANT DEED, HEREBY CONVEYING REAL PROPERTY TO THE STATE OF CALIFORNIA (“CALTRANS”), IDENTIFIED AS A PORTION OF ROADWAY PARALLEL TO HIGHWAY 4 (“BRENTWOOD BOULEVARD”) ON THE EAST SIDE AND WEST SIDE, GENERALLY LOCATED BETWEEN CENTRAL BOULEVARD AND VILLAGE DRIVE AND ANY OTHER DOCUMENTS NECESSARY TO COMPLETE THE TRANSACTION.


WHEREAS, on June 12, 2007, by Resolution No. 2007-126, City Council adopted the City’s 2007/08 - 20011/12 Capital Improvement Program (“CIP”) that included the Brentwood Boulevard Widening - Central, CIP Project No. 336-31490; and

WHEREAS, Caltrans requires that when widening and improvements are constructed on Brentwood Boulevard, that the right-of-way (travel roadway) for these improvements are conveyed to the State; and

WHEREAS, Caltrans is ready to move forward with the customary transfer process and a Grant Deed is required to transfer said property between the City of Brentwood and Caltrans as part of Brentwood Boulevard.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood approves a Grant Deed to the State of California and authorizes the City Manager or designee to execute said Grant Deed, hereby conveying real property to the State of California, identified as a portion of roadway parallel to Highway 4 on the east side and west side, generally located between Central Boulevard and Village Drive and any other documents necessary to complete the transaction.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a meeting held on the 24th day of June 2008 by the following vote:
