RECOMMENDATION
1) Decide Whether to Do Further Research Regarding a Local Preference Program and, if so, Appoint an Ad Hoc Committee to Work with Staff and Consultant and 2) Provide Direction to Staff Regarding Temporary Space for the Interim Library

PREVIOUS ACTION
On November 13, 2007, by Resolution No. 2007-269, City Council 1) endorsed the Civic Center Conceptual Plans; 2) endorsed the City Hall and Community Center Building Plans; 3) endorsed the History Walk concept as one of the Required Art Components of the Civic Center; and 4) directed staff to proceed with this project to design development.

On February 26, 2008, LPA, Inc. gave a presentation to City Council on milestones and critical decision points for the Civic Center project. The purpose was to inform City Council of when they would be required to make decisions that will affect the progress of the project.

On May 13, 2008, by Resolution No. 2008-115, City Council approved the Swinerton Management and Consulting contract for Construction Management services on the Civic Center.

On May 13, 2008, by Resolution No. 2008-116, City Council approved Staff’s recommendation for the fountain and the trees for the Civic Center Plaza.

On May 13 2008, by Resolution No. 2008-117, City Council endorsed the City Park Master Site Plan.

On May 13, 2008, City Council continued the issue of consideration of a Resolution directing staff to Prepare Temporary Space for the Interim Library and Council Chambers at the Brentwood Education and Technology Center and directed staff to bring back a budget analysis for the costs associated with moving the library.

BACKGROUND

Local Preference Program

At the May 13, 2008 City Council meeting, Councilmembers expressed an interest in having the Civic Center and other CIP projects create job opportunities for local businesses and directed staff to explore local preference programs. Staff has researched local preference and local vendor programs, inclusive of those already in existence in East Bay cities.

Prior to adopting a local preference or local hiring program, there are many constraints and legal issues to be explored. An overview of possible local preference program options and/or local vendor programs combined with legal constraints placed on General Law cities will be presented to Council on June 10th. Following the presentation, staff will be asking for City Council direction. Should City Council decide to move forward with developing a local preference program, staff recommends that the City Council create an ad hoc committee consisting of two Councilmembers to work with staff and Swinerton Management and Consulting to develop recommendations for Council consideration.

Provide direction to staff regarding temporary space for the interim library.

At the May 13, 2008 City Council meeting, City Council directed staff to bring back a budget analysis for the costs associated with moving the library to the annex building on Oak Street. Consideration was given to the following factors:

• schedule,
• expense,
• noise during construction of the Civic Center,
• parking and access to library during construction of the Civic Center,
• library operations, and
• impact on staff and consultants’ time, and
• ultimate remodel of the library.

Each of these factors will be reviewed in detail at the workshop presentation.

FISCAL IMPACT
Regarding the Local Preference Program, there is currently no known fiscal impact at this time. Until a program is identified, financial implications are unknown.

Regarding the library move, there is also no fiscal impact at this time. The funds associated with this project are included in the 2008/09 – 2012/13 CIP Budget which includes the Library Remodel and Interim Civic Center Facilities.
