RECOMMENDATION

Adopt a Resolution accepting the O'Hara and Lone Tree landscape improvements in the common area for Steeplechase LLD and Park, Subdivision No. 8674, located west of O’Hara Avenue between Neroly Road and Lone Tree Way by Richmond American Homes of California, Inc.

PREVIOUS ACTION

On May 18, 2004, by Resolution No. 04-33, Planning Commission approved Tentative Subdivision Map No. 8674, with conditions.

In order for the Final Map to be recorded, the City Manager approved the Subdivision Map, accepted the offers of dedication as shown on the Subdivision Improvement Map, and executed the Subdivision Improvement Agreement for Final Map No. 8674.

On December 12, 2006, City Council was notified through an Informational Report of the City Manager’s approval of Final Subdivision Map No. 8674, acceptance of improvements securities and approval of the Subdivision Agreement.

BACKGROUND
Subdivision No. 8674 of Tentative Subdivision Map (TSM) No. 8674, located west of O’Hara Avenue between Neroly Road and Lone Tree Way, has been developed by Richmond American Homes of California, Inc. (“Developer”) and contains 180 single-family residential lots.

As part of Subdivision No. 8674 landscape improvement plans, in accordance of the Conditions of Approval requirements and as part of the Subdivision Improvement Agreement, the Developer has designed and constructed the street widening and landscape improvements of O’Hara Avenue, Lone Tree Way, and Neroly Road adjacent to Subdivision No. 8674. The street landscape improvements are now installed to City standards: therefore, it is appropriate to accept the street landscape improvements as shown on the Subdivision No. 8674 landscape improvement plans.

The Developer has also installed the neighborhood park improvements on Parcel B of the Subdivision No. 8674 final map in accordance of the Conditions of Approval requirements and as required by the Subdivision Improvement Agreement. This approximate 1.1 acre neighborhood park, known as Park “A”, includes amenities such as a play area with a play structure, benches, picnic area, water fountain, shade components, park fence, irrigation system, turf, trees, ground cover and shrubs.

The Developer issued two Subdivision Improvement Bond Faithful Performance Bonds to the City related to the above described landscaping work: Subdivision Improvement Bond Faithful Performance Bond in the amount of $4,774,864 for In-Tract Improvements; and Subdivision Improvement Bond Faithful Performance Bond in the amount of $3,946,257.87 for Off-SiteTract Improvements (related to street widening and landscape improvements of O’Hara Avenue, Lone Tree Way, and Neroly Road adjacent to Subdivision No. 8674).

The bonds amounts were based on City of Brentwood Engineers Estimate for Public Improvements Bonding Purposes on Subdivision 8674. Under the miscellaneous section of the City estimate for the In-Tract improvements, the City indicates a value of $632,720 for landscaping and irrigation work for park improvements on Subdivision 8674. The Developer is not required to provide any Maintenance Bonds to cover a warranty period for any park improvements in the subdivision.

FISCAL IMPACT
Upon acceptance of the off-site street landscape improvements in the common area for Steeplechase LLD, and the 1.1 acre neighborhood park at Subdivision No. 8674, the City will incur annual costs associated with the necessary maintenance of the landscape improvements. The yearly estimated total maintenance cost for the off-site street landscaping and park is $34,918 of which $7306 is for the park and $27,612 is for the off-site street landscape improvements. Landscape and Lighting Assessment District No.03-2 has been formed for this subdivision for these costs.

A RESOLUTION ACCEPTING THE O'HARA AND LONE TREE LANDSCAPE IMPROVEMENTS IN THE COMMON AREA FOR STEEPLECHASE LLD AND PARK, SUBDIVISION NO. 8674, LOCATED WEST OF O’HARA AVENUE BETWEEN NEROLY ROAD AND LONE TREE WAY BY RICHMOND AMERICAN HOMES OF CALIFORNIA, INC., AND DIRECTING THE CITY CLERK TO FILE THIS RESOLUTION WITH THE RECORDER OF CONTRA COSTA COUNTY

WHEREAS, on May 18, 2004, by Resolution No. 04-33, Planning Commission approved Tentative Subdivision Map No. 8674, with conditions; and

WHEREAS, on December 12, 2006, City Council was notified through an Informational Report of the City Manager’s approval of Final Subdivision Map No. 8674, acceptance of improvements securities and approval of the Subdivision Agreement; and

WHEREAS, the required public improvements to the common area have been completed and constructed in substantial conformance with the approved improvement plans.

NOW, THERFORE BE IT RESOLVED, that the City Council of the City of Brentwood with respect to Subdivision No. 8674 LLD and Park landscape improvements, Steeplechase subdivision, development by Richmond American Homes:
1. All landscape improvements for Steeplechase subdivision No. 8674 LLD and Park are hereby accepted for maintenance.
2. The City Clerk is hereby directed to file Resolution with the Recorder of Contra Costa County.
