RECOMMENDATION
Adopt a Resolution accepting the Siena Village Park Improvements for Subdivision No. 8953, Siena Village, located at 301 Cortona Way, by Siena Partners L.L.C. (the Developer). C

PREVIOUS ACTION
On September 7, 2004, by Resolution No. 04-55, Planning Commission approved Vesting Tentative Subdivision Map No. 8781, with conditions.

On November 16, 2004, by Resolution No. 04-73, Planning Commission approved Tentative Parcel Map No. 358-04, with conditions.

In order for the Final Map to be recorded, the City Manager approved the Subdivision Map (which was renamed Subdivision Map No. 8953), accepted the offers of dedication as shown on the Subdivision Improvement Map, and executed the Subdivision Improvement Agreement for Final Map No. 8953 and park and trail improvements on the Remainder Parcel of Parcel Map No. 358-04 .

On July 26. 2005, City Council was notified through an Informational Report of the City Manager’s approval of Final Subdivision Map No. 8953, acceptance of improvements securities and approval of the Subdivision Agreement.

BACKGROUND
The Siena Village Park Improvements are part of the Siena Village Subdivision Map (TSM) No. 8953, and Parcel Map (PM) No. 358-04 located at 301 Cortona Way.

As part of Subdivision No. 8953 improvement plans, as part of the Conditions of Approval requirements, and as part of the Subdivision Improvement Agreement, the Developer has constructed 90 residential lots (and ancillary streets, landscaping and utilities) on 30.7 acres of land. In addition, Developer has also constructed parks totaling 0.47 acres.

In addition to the acreage above, and included with the Improvement Plans addressing Parcel Map No. 358-04, as part of the Conditions of Approval requirements, and as part of the Subdivision Improvement Agreement, the Developer has constructed a tot lot and open space and trail area totaling approximately 1.83 acres. These improvements are now installed to City Standards; therefore, it is appropriate to accept the Siena Village Park Improvements as offered on the Final Map.

The Developer issued two bonds to the City on the proposed subdivision: Subdivision Improvement Bond Faithful Performance Bond # 720032S in the amount of $2,768,035 and Subdivision Bond Payment same number as Performance Bond for $2,768,035 The bond amounts were based on City of Brentwood Engineers Estimate for Public Improvements Bonding Purposes on Subdivision No. 8953. The civil improvements are bonded with Bond # 720032S and the Developer will provide one warranty bond for all improvements.

FISCAL IMPACT
Upon acceptance of the Siena Village Park Improvements, the City will incur annual costs associated with the necessary maintenance of the improvements. The yearly estimated total maintenance cost for the Siena Village Park Improvements is $56,243.60, Landscape and Lighting Assessment District No. 03-5 has been formed for this subdivision for these costs.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE SIENA VILLAGE PARK IMPROVEMENTS OFFERS OF DEDICATION IN-FEE; ACCEPTING RIGHTS SHOWN ON THE FINAL MAP FOR THE SIENA VILLAGE PARK IMPROVEMENTS; ACCEPTING THE SIENA VILLAGE PARK IMPROVEMENTS FOR MAINTENANCE ON SUBDIVISON NO. 8953, SIENA VILLAGE, LOCATED AT 301 CORTONA WAY, BY SIENA PARTNERS L.L.C , AND DIRECTING THE CITY CLERK TO FILE THIS RESOLUTION WITH THE RECORDER OF CONTRA COSTA COUNTY

WHEREAS, on September 7, 2004, by Resolution No. 04-55 Planning Commission approved Tentative Subdivision Map No. 8953, with conditions; and

WHEREAS, on November 16, 2004, by Resolution No. 04-73 Planning Commission approved Tentative Parcel Map No. 358-04, with conditions; and

WHEREAS, on July 26, 2005, City Council was notified through an Informational Report of the City Manager’s approval of Final Subdivision Map No. 8953, acceptance of improvements securities and approval of the Subdivision Agreement; and

WHEREAS, the required public improvements to the park and trail have been completed and constructed in substantial conformance with the approved improvement plans.

NOW, THERFORE BE IT RESOLVED, that the City Council of the City of Brentwood with respect to Subdivision No. 8953, Siena Village Park Improvements, Siena Village development by Siena Partners L.L.C. :
1. Accepts offers of dedication in-fee simple, as shown on the final map for Siena Village Park Parcel A Improvements.
2. Accepts offers of dedication in-fee simple, as shown on the final map for Siena Village Park Parcel B Improvements.
3. Accepts offers of dedication in-fee simple, as shown on the Parcel Map 358-04 for Siena Village Park and Trail Remainder Parcel Improvements.
4. Accepts all Siena Village Park Improvements for maintenance.
5. Directs the City Clerk to file this Resolution with the Recorder of Contra Costa County.
