RECOMMENDATION
Adopt a Resolution accepting the Sage Glen Estates Trail Improvements and the Lighting and Landscape District for Subdivision No. 8854, Castello Property, located at the northeast corner of Balfour Road and Fairview Avenue, by Western Pacific Housing, Inc.

PREVIOUS ACTION
On February 1, 2005, by Resolution No. 05-09, Planning Commission approved Vesting Tentative Subdivision Map No. 8854, with conditions.

In order for the Final Map to be recorded, the City Manager approved the Subdivision Map, accepted the offers of dedication as shown on the Subdivision Improvement Map, and executed the Subdivision Improvement Agreement for Final Map No. 8854.

On October 11, 2005, City Council was notified through an Informational Report of the City Manager’s approval of Final Subdivision Map No. 8854, acceptance of improvements securities and approval of the Subdivision Agreement.

BACKGROUND
The Sage Glen Estates Trail Improvements are part of the Castello Property Tentative Subdivision Map (TSM) No. 8854, located at the northeast corner of Balfour Road and Fairview Avenue.

As part of Subdivision No. 8854 improvement plans, as part of the Conditions of Approval requirements, and as part of the Subdivision Improvement Agreement, the Developer has designed, constructed and landscaped a trail within the ECCID parcel bordering the project site on the east. These improvements are now installed to City Standards; therefore, it is appropriate to accept the Sage Glen Trail Improvements and the Subdivision’s Lighting and Landscape District who will maintain the improvements.

The Developer issued two bonds to the City on the proposed subdivision: Subdivision Improvement Bond Faithful Performance Bond #929374411 in the amount of $5,814,778.00 and Subdivision Bond Payment #929374411 for $5,814,778.00. The bond amounts were based on City of Brentwood Engineers Estimate for Public Improvements Bonding Purposes on Subdivision 8854. The civil improvements are bonded with Bond #929374411 and the Developer will provide one warranty bond for all improvements.

FISCAL IMPACT
Upon acceptance of the Sage Glen Lighting and Landscape and Trail the City will incur annual costs associated with the necessary maintenance of the improvements. The yearly estimated total maintenance cost for the Sage Glen Lighting and Landscape and Trail is $94,767.50. Landscape and Lighting Assessment District No. 03-3 has been formed for this subdivision for these costs.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE SAGE GLEN TRAIL IMPROVEMENTS AND THE LIGHTING AND LANDSCAPE DISTRICT IN-FEE; ACCEPTING RIGHTS SHOWN ON THE FINAL MAP FOR THE SAGE GLEN TRAIL IMPROVEMENTS; ACCEPTING THE SAGE GLEN TRAIL IMPROVEMENTS FOR MAINTENANCE ON SUBDIVISON NO. 8854, CASTELLO PROPERTY, LOCATED AT THE NORTHEAST CORNER OF BALFOUR ROAD AND FAIRVIEW AVENUE, BY WESTERN PACIFIC HOUSING INC., AND DIRECTING THE CITY CLERK TO FILE THIS RESOLUTION WITH THE RECORDER OF CONTRA COSTA COUNTY

WHEREAS, on February 1, 2005, by Resolution No. 05-09, Planning Commission approved Tentative Subdivision Map No. 8854, with conditions; and

WHEREAS, on August 18, 2005, City Council was notified through an Informational Report of the City Manager’s approval of Final Subdivision Map No. 8854, acceptance of improvements securities and approval of the Subdivision Agreement; and

WHEREAS, the required public improvements to the park and trail have been completed and constructed in substantial conformance with the approved improvement plans.

NOW, THERFORE BE IT RESOLVED, that the City Council of the City of Brentwood with respect to Subdivision No. 8854, Sage Glen Trail Improvements, Sage Glen Estates, development by Western Pacific Housing, Inc. :
1. Accepts all Sage Glen Trail and Lighting and Landscape District Improvements for maintenance.
2. Directs the City Clerk to file this Resolution with the Recorder of Contra Costa County.
