| MEMORANDUM FROM THE CITY ATTORNEY CONCERNING A CLOSED SESSION BEFORE THE CITY COUNCIL OF THE CITY OF BRENTWOOD TO: Honorable Mayor and Members of the City Council FROM: Damien Brower, City Attorney SUBJECT: Closed Session CONFERENCE WITH REAL PROPERTY NEGOTIATORS [Gov’t. Code § 54956.8] Property: Portion of property located near intersection of Brentwood Blvd. and Sand Creek Road APN: 016-170-010 (portion) Negotiating Party: Franklin Four, LLC; Thomas Franklin, LLC; SSB, LLC City Negotiators: Bailey Grewal/Paul Eldredge Under Negotiation: Price and terms of payment A closed session will be held on May 13, 2008, for the purpose of giving instructions to your negotiator regarding the price and terms of payment for the purchase, sale, exchange or lease of real property. [Gov’t. Code §54956.8] If the City Council renders an agreement final, they shall report that approval and the substance of the agreement in open session at the public meeting during which the closed session is held. [Gov’t Code §54957.1(a)(1)(A)] If final approval rests with the other party to the negotiations, the City Council shall disclose the fact of approval and the substance of the agreement upon inquiry by any person, as soon as the other party or its agent has informed the City Council of its approval.
