Subject/Title: Adopt a Resolution approving and authorizing the City Manager or designee to execute Amendment No. Two to the Professional Services Agreement with NorthStar Engineering Group, Inc. for the Brentwood Business Park Improvements, CIP Project No. 336-31682, in an amount not to exceed $21,620, and amending the CIP Budget Sheet to include the additional scope of work.

RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager or designee to execute Amendment No. Two to the Professional Services Agreement with NorthStar Engineering Group, Inc. for the Brentwood Business Park Improvements, CIP Project No. 336-31682, in an amount not to exceed $21,620, and amending the CIP Budget Sheet to include the additional scope of work.

PREVIOUS ACTION
On September 26, 2006, by Resolution No. 2006-234, City Council approved a Memorandum of Understanding (“MOU”) between the City, Equus Group, Liberty Union High School District and various property owners for shared development responsibilities of the “Brentwood Business Park”.

On June 12, 2007, by Resolution No. 2007-126, City Council adopted the City’s 2007/08 – 2011/12 Capital Improvement Program that included the Brentwood Business Park Improvements Project.

On November 13, 2007, by Resolution No. 2007-265, City Council approved and authorized the City Manager or designee to execute a Professional Services Agreement with NorthStar Engineering Group, Inc. for engineering design services for a portion of the Brentwood Business Park, located east of Guthrie Lane, in an amount not to exceed $131,195, plus a 10% contingency, for a total amount of $144,314.50, and amended the CIP Budget Sheet.

BACKGROUND
The Brentwood Business Park includes the development of approximately 43 acres in the southeast corner of the City, specifically, east of Guthrie Lane and west of Sellers Avenue. The future site will predominately incorporate office and light industrial development, but will also include the Liberty Union High School District’s (“LUHSD”) new La Paloma school site, to be relocated from Lone Tree Way. In order to assist LUHSD to relocate the school to a more desirable site, allow appropriate development in the Lone Tree Way area and initiate the development of the Business Park, the City, LUHSD and the property owners entered into a previously City Council approved MOU outlining development of the site.

The City project of the Brentwood Business Park Improvements consists of construction of the infrastructure improvements to serve the first phase of the industrial park leading to the school site, including widening of Guthrie Lane south of Balfour Road. The City contracted with NorthStar Engineering Group, Inc. on November 13, 2007, for the engineering design services for the infrastructure portion of the project.

Amendment No. One of this agreement was executed on March 11, 2008, to use the 10% contingency previously approved by City Council, for a storm drainage hydraulic capacity analysis for a conveyance pipeline within the project area.

During preliminary design, it was discovered that the sewer facilities located on Guthrie Lane would not be adequate to serve the Brentwood Business Park and the new La Paloma school site. Staff researched alternative sewer locations and decided the best alternative for the sewer service for the Business Park location would need to come from Balfour Road along Sellers Avenue.

Since the original CIP Budget Sheet did not include a sewer line along Sellers Avenue, staff has added that additional scope of work to the Budget Sheet and is requesting City Council’s approval.

The design of this sewer line along Sellers Avenue is outside the scope of the original contract with NorthStar Engineering Group, Inc., therefore, staff requested a proposal from them to include this additional work. Amendment No. Two includes engineering design and construction staking services necessary for the addition of the Sellers Avenue sanitary sewer pipe line extension.

FISCAL IMPACT
The total amount of the agreement, including both amendments, is $165,943.50 and is within the project budget available for the 2007/08 fiscal year.

ADOPT A RESOLUTION APPROVING AND AUTHORIZING THE CITY MANAGER OR DESIGNEE TO EXECUTE AMENDMENT NO. TWO TO THE PROFESSIONAL SERVICES AGREEMENT WITH NORTHSTAR ENGINEERING GROUP, INC. FOR THE BRENTWOOD BUSINESS PARK IMPROVEMENTS, CIP PROJECT NO. 336-31682, IN AN AMOUNT NOT TO EXCEED $21,620, AND AMENDING THE CIP BUDGET SHEET TO INCLUDE THE ADDITIONAL SCOPE OF WORK.

1. Amend the CIP Budget Sheet to include the additional scope of work for the Brentwood Business Park Improvements, CIP Project No. 336-31682; and
2. Execute Amendment No. Two to the Professional Services Agreement with NorthStar Engineering Group, Inc. for the Brentwood Business Park Improvements, CIP Project No. 336-31682, in an amount not to exceed $21,620.
