Subject/Title: Adopt a Resolution approving and authorizing the City Manager or designee to execute a Cost Sharing Agreement for Improvements to American Avenue with the Liberty Union High School District and Brentwood Union School District for shared responsibilities of the improvements recommended by the American Avenue Task Force.

RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager or designee to execute a Cost Sharing Agreement for Improvements to American Avenue with the Liberty Union High School District (“LUHSD”) and Brentwood Union School District (“BUSD”) for shared responsibilities of the improvements recommended by the American Avenue Task Force.

PREVIOUS ACTION
On November 13, 2007, City Council authorized the Mayor to invite the School Districts, Contra Costa County and parent representatives to participate in a task force on American Avenue.

On April 8, 2008, City Council accepted a report on the American Avenue Task Force and supported the Task Force recommendations with construction bid alternatives.

BACKGROUND
Many safety and traffic congestion concerns have been raised by residents and school officials using American Avenue to access Adam’s Middle School and Heritage High School. Improvements have been made, though concerns continue to remain. In an effort to gain assistance from all parties to provide relief, the City Council authorized formation of the American Avenue Task Force to brainstorm and propose recommendations that could be implemented by the agencies, parents and students. Recommendations have been made and narrowed to two main scopes of work:

Safety related: Construct an asphalt path on the east side of American Avenue to separate pedestrians, bicyclists and skateboarders from the vehicular travel lane.

Traffic Congestion related: Restriping of American Avenue to provide additional southbound lanes, additional turn lanes into the Heritage High School Parking Lot including entrance median modifications.

This Cost Sharing Agreement between the City, LUHSD and BUSD more specifically describes the construction and financial responsibilities of each party to implement the Task Force recommendations. Key points of the agreement include (1) design, bid and construction of the improvements by the City, and (2) one-third cost sharing by all parties. Provisions of the agreement also include the ability for additional scopes of work, as bid alternates, in the event construction bids are sufficiently low enough to include the alternates within the project budget.


FISCAL IMPACT
The Cost Sharing Agreement identifies a budget of $185,000. At a one-third cost share, the City's contribution is estimated at $62,000, to be funded from the General Fund. American Avenue Improvements, CIP Project 336-31681, is included in the 2007/08 - 2011/12 CIP Budget. Upon agreement execution by all parties, staff will return to Council, tentatively scheduled for May 27, 2008, to award a construction contract and amend the budget for the contract if required.

ADOPT A RESOLUTION APPROVING AND AUTHORIZING THE CITY MANAGER OR DESIGNEE TO EXECUTE A COST SHARING AGREEMENT FOR IMPROVEMENTS TO AMERICAN AVENUE WITH THE LIBERTY UNION HIGH SCHOOL DISTRICT AND THE BRENTWOOD UNION SCHOOL DISTRICT FOR SHARED RESPONSIBILITIES OF THE IMPROVEMENTS RECOMMENDED BY THE AMERICAN AVENUE TASK FORCE.

WHEREAS, safety and traffic congestion concerns have been raised by residents and school officials using American Avenue to access Adam’s Middle School and Heritage High School; and

WHEREAS, on November 13, 2007, City Council authorized formation of the American Avenue Task Force to brainstorm and propose recommendations that can be implemented by the agencies, parents and students; and

WHEREAS, on April 8, 2008, City Council accepted a report on the American Avenue Task Force and supported the Task Force recommendations with construction bid alternatives; and

WHEREAS, the Cost Sharing Agreement for Improvements to American Avenue outlines the construction and financial responsibilities of the parties.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve and authorize the City Manager or designee to execute a Cost Sharing Agreement for Improvements to American Avenue with the Liberty Union High School District and Brentwood Union School District for shared responsibilities of the improvements recommended by the American Avenue Task Force.
