RECOMMENDATION
Adopt a Resolution approving the closure of streets for the use of City-owned property for the staging of the 2008 Multi-Cultural Celebration by the City of Brentwood Parks and Recreation Department on June 13, 2008.

PREVIOUS ACTION
On April 13, 2004, the City Council approved Ordinance 779 amending section 17.850 of the Brentwood Municipal Code relating to temporary use permits. The amended code provides that under 17.850.006 Exemptions: The provisions of this chapter shall not apply to arts and crafts fairs, health and safety fairs, business fairs, athletic field rentals, sport tournaments and contests, block parties, food and clothing giveaways, park dedications, music recitals, art shows and receptions, City building and gazebo rentals, community meetings and other similar uses that typically occur at community facilities. All City-managed or co-managed events are exempt from the requirements of obtaining a Temporary Use Permit. These exemptions shall apply to all of the events listed above, except as noted in 17.850.005(12).

On June 26, 2007 by Resolution 2007-132 City Council approved to Award Business License Tax Grant Monies to the Brentwood Chamber of Commerce and the City of Brentwood.

BACKGROUND
The proposed closure of street use is reasonably conditioned to mitigate identified impacts or to ensure public health, safety or welfare.

The 2008 Multi-Cultural Celebration is sponsored by the City of Brentwood Parks and Recreation Department and will kick off this year’s “Starry Night” concert series. Approximately three hundred people will participate at this event that will take place in City Park and in the parking lot located between Liberty High School and the Community Center. The parking lot will be used as a staging area for an equestrian show.

The Parks and Recreation Department is recommending the closure of Maple Street, the Library Parking lot (Maple Street between Liberty High School and the Community Center) and the access road on Maple Street leading out to Oak Street. It is the Parks and Recreation Department’s belief that this will have a moderate impact on the Liberty and the Library parking areas. Twelve general barricades, two “Road Closed” signs, and one “Road Closed Ahead” sign will be needed for these areas.

FISCAL IMPACT
The total cost of providing police services for the 2008 Multi-Cultural Celebration has been estimated at $473.20 by the Brentwood Police Department. The costs for services were budgeted in the 2007/08 Operating Budget. The Police Department will deploy Reserve Officers, Community Service Officers, and Volunteers where appropriate to reduce personnel costs. There is no charge for the signs, as they belong to City of Brentwood. All other expenses are covered by the Business License Tax City Grant Fiscal Year 07/08.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AND ALLOWING THE USE OF CITY STREETS AND AUTHORIZING THE CLOSURE OF CERTAIN STREETS AND TEMPORARILY ESTABLISHING NO PARKING RESTRICTIONS AND TOW AWAY ZONES IN ORDER TO FACILITATE THE CITY OF BRENTWOOD PARKS AND RECREATION DEPARTMENT’S 2008 MULTICULTURAL CELEBRATION TO BE HELD ON JUNE 13, 2008.


WHEREAS, the City of Brentwood Parks and Recreation Department will be holding their 2008 Multi-Cultural Celebration on Friday, June 13, 2008, an event of significance which attracts people to the downtown area; and

WHEREAS, to accommodate the 2008 City of Brentwood Parks and Recreation Department’s 2008 Multi-Cultural Celebration, it is requested that the following streets be closed to traffic and no parking and tow away zones be established between 5:30 p.m. and 10:00 p.m. on Friday, June 13, 2008.

• Maple Street
• The Library Parking lot (Maple Street between Liberty High School and the Community Center)
• Access road on Maple Street leading out to Oak Street

WHEREAS, pursuant to Vehicle Code Section 21101(e), the City may temporarily close portions of streets for parades and local special events such as the City of Brentwood Parks and Recreation Department’s 2008 Multi-Cultural Celebration when the closing is necessary for the safety and protection of persons who are to use those portions of the street during the temporary closure; pursuant to Vehicle Code Section 22507, the City may prohibit parking on portions of streets during all or certain hours of the day; pursuant to Vehicle Code Section 22651(b), (m), and (n), City peace officers may remove by towing any vehicle from those portions of the street where parking is prohibited; and

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Brentwood hereby approves and has ordered the Police Department to close the previously-mentioned streets, prohibit parking, and establish tow away zones between the hours of 5:30 p.m. and 10 p.m., on Friday, June 13, 2008.
