Subject/Title: Adopt a Resolution authorizing the City Engineer to temporarily close Marsh Creek Road from Orchard Lane to Camino Diablo for a period not to exceed five working days, for the State Route 4 Bypass Authority to facilitate necessary pavement reconstruction work as part of Segment 3 of the State Route 4 Bypass.

RECOMMENDATION
Adopt a Resolution authorizing the City Engineer to temporarily close Marsh Creek Road from Orchard Lane to Camino Diablo for a period not to exceed five working days, for the State Route 4 Bypass Authority (“Bypass Authority”) to facilitate necessary pavement reconstruction work as part of Segment 3 of the State Route 4 Bypass (“Bypass”).

BACKGROUND
The Bypass Authority is moving forward with construction of Segment 3 of the Bypass. In order to complete the connection of Marsh Creek Road, between an existing and new pavement section, a road closure is necessary. This will allow the contractor to construct the connection in a more rapid time frame, rather than if vehicular traffic were allowed adjacent to the construction area. The construction is scheduled for late April to early May. During the closure, traffic will be re-routed along the segment of Camino Diablo, Walnut Boulevard and Orchard Lane; however, local access will be provided to abutting property owners. Keeping safety as the foremost priority and to minimize the inconvenience to the commuters and general public, staff concurs with the Bypass Authority to close this portion of Marsh Creek Road for a maximum of five working days. Closure of the road will expedite the construction process and will minimize the construction time required to complete the connection related work. The included detour plan for these improvements have been reviewed and approved by the City Engineer. The City Engineer will approve the detour signing plan and determine when to allow the Bypass Authority to proceed with the work. The Bypass Authority will notify the Police Department, Fire Department, property owners and other impacted agencies of this closure with a minimum of 72 hours advance notice.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CITY ENGINEER TO TEMPORARILY CLOSE MARSH CREEK ROAD FROM ORCHARD LANE TO CAMINO DIABLO FOR A PERIOD NOT TO EXCEED FIVE WORKING DAYS, FOR THE STATE ROUTE 4 BYPASS AUTHORITY TO FACILITATE NECESSARY PAVEMENT RECONSTRUCTION WORK AS PART OF SEGMENT 3 OF THE STATE ROUTE 4 BYPASS.


WHEREAS, the State Route 4 Bypass Authority is constructing Segment 3 of the State Route 4 Bypass; and

WHEREAS, the connection between an existing and new section of Marsh Creek Road needs to be constructed; and

WHEREAS, this construction needs to occur without the presence of vehicular traffic in order to expedite its completion and ensure safety for motorists; and

WHEREAS, this work is scheduled to be completed in late April and early May 2008, weather permitting; and

WHEREAS, the most feasible and timely approach in order to complete the construction is to close Marsh Creek Road from Orchard Lane to Camino Diablo; and

WHEREAS, during the closure, traffic will be re-routed along the segment of Camino Diablo, Walnut Boulevard and Orchard Lane; and

WHEREAS, the detour plan for these improvements has been reviewed and approved by the City Engineer; and

WHEREAS, the City Engineer will approve the signing plan and determine when to allow the State Route 4 Bypass Authority to proceed with the work; and

WHEREAS, the State Route 4 Bypass Authority will notify the Police Department, Fire Department, property owners and other impacted agencies of this closure with a minimum of 72 hours advance notice; and

WHEREAS, per Brentwood Municipal Code Section 10.04.120, City Council is authorized to approve a full street closure for construction.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby authorize the City Engineer to temporarily close Marsh Creek Road from Orchard Lane to Camino Diablo for a period not to exceed five working days, for the State Route 4 Bypass Authority to facilitate necessary pavement reconstruction work as part of Segment 3 of the State Route 4 Bypass.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 22nd day of April 2008 by the following vote:
