Subject/Title: Adopt a Resolution approving and authorizing the City Manager or her designee to execute a Professional Services Agreement with Eco:Logic Engineering for Groundwater Evaluation Studies which include a Groundwater Monitoring Work Plan and a Groundwater Quality Characterization to meet the requirements of the recently adopted Wastewater Treatment Plant Discharge permit in an amount not to exceed $51,500.

RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager or her designee to execute a Professional Services Agreement with Eco:Logic Engineering for Groundwater Evaluation Studies which include a Groundwater Monitoring Work Plan and a Groundwater Quality Characterization to meet the requirements of the recently adopted Wastewater Treatment Plant Discharge permit in an amount not to exceed $51,500.

BACKGROUND
The City of Brentwood Wastewater Treatment Plant recently underwent a National Pollutant Discharge Elimination System (NPDES) permit renewal process with the Central Valley Regional Water Quality Control Board (CVRWQCB). The new NPDES permit was adopted at the January 25 2008, CVRWQCB meeting. Newly adopted NPDES permits require implementation of various special studies, work plans, and compliance schedules that have mandatory completion dates.

The CVRWQCB is requiring the City of Brentwood to conduct a groundwater study to demonstrate the Wastewater Treatment Plant is not contaminating the groundwater basin. This comes as a result of CVRWQCB policy which requires groundwater studies be completed in newly adopted NPDES permits in order to protect existing water resources in the State of California.

The Groundwater Evaluation Study requirements are specific and necessitate the services of a technical expert that is experienced in conducting groundwater studies. Eco:Logic Consulting Engineers have the required technical expertise for these particular types of groundwater studies. The expertise is demonstrated by the fact that Eco:Logic routinely performs groundwater studies of the same scope and purpose. In addition, Eco:Logic has provided documented results for each study performed, which is noted in Exhibit “A.” In the past, Eco:Logic has provided design and construction inspection services for the City’s Wastewater Treatment Plant . Also, last year they prepared the Wastewater Treatment Plant Expansion Study to provide options for any necessary changes or upgrades due to ongoing regulatory changes.

FISCAL IMPACT
The total fiscal impact of this agreement is $51,500. The amount of $15,500 will be expended in the fiscal year 2007/08 Wastewater Enterprise Operating Budget and $10,000 will be expended in the fiscal year 2008/09 Wastewater Enterprise Operating Budget. These amounts are included in the adopted Operating Budgets for fiscal years 2007/08 and 2008/09. The remaining $26,000 will be budgeted for during the next two-year budget cycle commencing in 2009/10. The breakdown of cost per fiscal year is noted in Exhibit “B.” This Professional Services Agreement is in compliance with Purchasing Policy 10-7.

A RESOLUTION APPROVING AND AUTHORIZING THE CITY MANAGER OR HER DESIGNEE TO EXECUTE A PROFESSIONAL SERVICES AGREEMENT WITH ECO:LOGIC ENGINEERING FOR GROUNDWATER EVALUATION STUDIES WHICH INCLUDE A GROUNDWATER MONITORING WORK PLAN AND GROUNDWATER QUALITY CHARACTERIZATION TO MEET THE REQUIREMENTS OF THE RECENTLY ADOPTED WASTEWATER TREATMENT PLANT DISCHARGE PERMIT IN AN AMOUNT NOT TO EXCEED $51,500.

WHEREAS, on January 25, 2008, the new City of Brentwood National Pollutant Discharge Elimination System (NPDES) permit was adopted by the Central Valley Regional Water Quality Control Board (CVRFWQCB); and

WHEREAS, newly adopted NPDES permits require implementation of various special studies, work plans, and compliance schedules that have mandatory completion dates; and

WHEREAS, the CVRWQCB is requiring the City of Brentwood to conduct a groundwater study to demonstrate the wastewater treatment facility is not contaminating the groundwater basin; and

WHEREAS, the Groundwater Evaluation Study requirements are specific and necessitate the services of a technical expert that is experienced in conducting groundwater studies; and

WHEREAS, Eco:Logic routinely performs groundwater studies of the same scope and purpose; and

WHEREAS, on June 26, 2007, by Resolution No. 2007-150, City Council adopted the 2007/08 – 2008/09 Operating Budget for the City of Brentwood; and

WHEREAS, an amount of $25,500 has been budgeted for in the 2007/08 and 2008/09 Operating Budget; and

WHEREAS, the remaining $26,000 will be budgeted for during the next two-year budget cycle commencing in fiscal year 2009/10 for a total agreement amount of $51,500; and

WHEREAS, this professional services agreement is in compliance with Purchasing Policy 10-7.


NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood approves and authorizes the City Manager or her designee to execute a professional services agreement with Eco:Logic Consulting in a total amount not to exceed $51,500 for required Groundwater Evaluation Studies which includes a Groundwater Monitoring Work Plan and a Groundwater Quality Characterization to meet the requirements of the recently adopted Wastewater Treatment Plant Discharge NPDES permit.
