RECOMMENDATION
Adopt a Resolution accepting King Park Improvements for Subdivision No. 8529, Crossroads II, located on the north side of Sand Creek Road and west of Minnesota Avenue by Ponderosa Homes Inc., and accepting a $20,000 cash bond for remedial repairs to dog park sod. PREVIOUS ACTION
On September 18, 2001, by Resolution No. 01-67, Planning Commission approved Vesting Tentative Subdivision Map No. 8529, with conditions; and

On December 17, 2002 and October 21, 2003, Planning Commission amended Resolution No. 01-67, and approved one year time extensions for the Tentative Subdivision Map; and

On April 27, 2004, by an Informational Report, City Council was notified of the City Manager’s approval of Final Subdivision Map No. 8529, and associated Subdivision Improvement Agreement; and

On May 23, 2006, by Resolution No. 2006-123, City Council approved an interim Park Maintenance Agreement between Ponderosa Homes and the City of Brentwood for King Park (“Maintenance Agreement”); and

On December 11, 2007, by Resolution No. 2007-273, City Council accepted Public Improvements for maintenance, excluding King Park for Subdivision No. 8529.

BACKGROUND
The King Park Improvements are part of the Tentative Subdivision Map (TSM) No. 8529 and located on the north side of Sand Creek Road and west of Minnesota Avenue by Ponderosa Homes, Inc. (“Developer”).

As part of Subdivision No. 8529 improvement plans, as part of the Conditions of Approval requirements, and as part of the Subdivision Improvement Agreement, the Developer has constructed an area of landscaping including shrubs, irrigation, one backflow device, local remote irrigation controllers, and a booster pump. These King Park Improvements are now installed to City Standards; therefore, it is appropriate to accept the Park Improvements as offered on the Final Map.

The Subdivision Performance and payment Bonds were released under Resolution 2007-273 and the Maintenance Bonds to cover the twelve-month warranty period for all improvements was accepted on December 11, 2007.

The City accepted a $20,000 cash bond to repair damage to the sod in the dog park. Ponderosa Homes, Inc. is required to resod a portion of this area but if they fail to do so, we will use this bond to perform the work.

FISCAL IMPACT
Upon acceptance of the King Park improvements, the City will incur annual maintenance costs of $88,345. The maintenance costs for this park are funded by the City Wide Park Assessment District.

ADOPT A RESOLUTION ACCEPTING KING PARK IMPROVEMENTS FOR SUBDIVISION NO. 8529, CROSSROADS II, LOCATED ON THE NORTH SIDE OF SAND CREEK ROAD AND WEST OF MINNESOTA AVENUE BY PONDEROSA HOMES INC., ACCEPTING A $20,000 CASH BOND FOR REMEDIAL REPAIRS TO DOG PARK SOD, AND DIRECTING THE CITY CLERK TO FILE THIS RESOLUTION WITH THE RECORDER OF CONTRA COSTA COUNTY.

WHEREAS, on September 18, 2001, by Resolution No. 01-67, Planning Commission approved Vesting Tentative Subdivision Map No. 8529, with conditions; and

WHEREAS, on December 17, 2002 and October 21, 2003, Planning Commission amended Resolution No. 01-67, and approved one year time extensions for the Tentative Subdivision Map; and

WHEREAS, on April 27, 2004, by an Informational Report, City Council was notified of the City Manager’s approval of Final Subdivision Map No. 8529, and associated Subdivision Improvement Agreement; and

WHEREAS, on May 23, 2006, by Resolution No. 2006-123, City Council approved an Interim Park Maintenance Agreement between Ponderosa Homes and the City of Brentwood for King Park; and

WHEREAS, on December 11, 2007, by Resolution No. 2007-273, City Council accepted Public Improvements for maintenance, excluding King Park for Subdivision No. 8529; and

WHEREAS, the required public improvements to King Park have been completed and constructed in substantial conformance with the approved improvement plans; and

WHEREAS, upon acceptance of the improvements, the Interim Park Maintenance Agreement shall terminate.

NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of Brentwood with respect to Subdivision No. 8529 King Park, Crossroads II, development by Ponderosa Homes, Inc.:

1. Accepts the King Park public improvements for maintenance.
2. Accepts a $20,000 cash bond for remedial repairs.
3. Directs the City Clerk to file this Resolution with the Recorder of Contra Costa County.
