RECOMMENDATION
Adopt a Resolution accepting public improvements for maintenance; accepting the Maintenance Bond; and releasing the associated Improvement Securities for the EBMUD trail and landscaping constructed as a part of Subdivision No. 8416, Sunset Crossing, located south of Sunset Road and east of Brentwood Boulevard, developed by DeNova Homes.

PREVIOUS ACTION
On November 8, 2000, by Resolution No. 00-75, Planning Commission approved Tentative Subdivision Map No. 8416, with conditions.

On October 8, 2002, by Resolution No. 2696, City Council approved Final Subdivision Map No. 8416, accepted the improvement securities and approved the Subdivision Improvement Agreement.

On January 21, 2003, Planning Commission amended Resolution No. 00-75, amending the Conditions of Approval for Tentative Subdivision Map No. 8416.

On April 10, 2007, by Resolution No. 2007-65, City Council accepted the public improvements, excluding EBMUD trail and landscaping, constructed by DeNova Homes as a part of Subdivision 8416.

BACKGROUND
This subdivision, located south of Sunset Road and east of Brentwood Boulevard, contains 133 single-family residential lots. In April 2007 the civil improvements (roadways and utilities) were complete to City satisfaction, though the EMBUD trail and landscaping improvements were not quite complete. At that time, DeNova Homes posted a separate bond to guarantee the landscaping and the civil improvements were accepted for City maintenance. The EBMUD trail and landscaping is now complete per the Conditions of Approval for this subdivision and have been constructed and inspected for conformance with the approved improvement plans and City Standards. The improvements include approximately 2.75 acres of turf, shrubs, asphalt trail, fencing and irrigation system. A Maintenance Bond has been provided to cover the twelve-month warranty period for the public improvements that are now complete.

FISCAL IMPACT
Upon acceptance of improvements the City will incur annual costs associated with necessary maintenance of landscaping. The yearly estimated total maintenance cost for the Public Landscaping Improvements is $41,443. Landscape and Lighting Assessment District (LLD) No. 01-1 has been formed for this subdivision to pay for these costs.

RESOLUTION NO.


A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING PUBLIC IMPROVEMENTS FOR MAINTENANCE; ACCEPTING THE MAINTENANCE BOND; AND RELEASING THE ASSOCIATED IMPROVEMENT SECURITIES FOR THE EBMUD TRAIL AND LANDSCAPING CONSTRUCTED AS A PART OF SUBDIVISION NO. 8416, SUNSET CROSSING, LOCATED SOUTH OF SUNSET ROAD AND EAST OF BRENTWOOD BOULEVARD, DEVELOPED BY DENOVA HOMES; AND DIRECTING THE CITY CLERK TO FILE THIS RESOLUTION WITH THE RECORDER OF CONTRA COSTA COUNTY


WHEREAS, on November 8, 2000, by Resolution No. 00-75, Planning Commission approved Tentative Subdivision Map No. 8416, with conditions; and

WHEREAS, on October 8, 2002, by Resolution No. 2696, City Council approved Final Subdivision Map No. 8416, accepted the improvement securities and approved the Subdivision Improvement Agreement; and

WHEREAS, on January 21, 2003, Planning Commission amended Resolution No. 00-75, amending the Conditions of Approval for Tentative Subdivision Map No. 8416; and

WHEREAS, on April 10, 2007, by Resolution No. 2007-65, City Council accepted the public improvements, excluding EBMUD trail and landscaping, constructed by DeNova Homes as a part of Subdivision 8416.

WHEREAS, the required EBMUD trail and landscaping improvements have been completed and constructed in substantial conformance with the approved improvement plans; and

WHEREAS, DeNova Homes has posted a Maintenance Bond for the EBMUD trail and landscape improvements.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood with respect to EBMUD trail and landscaping improvements constructed as a part of Subdivision No. 8416, Sunset Crossing, developed by DeNova Homes that:

1. The EBMUD trail and landscaping improvements are hereby accepted for maintenance.
2. The Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.
3. The associated Performance and Payment Bonds will be released within sixty (60) days of the passage of this Resolution.
4. The City Clerk is directed to file this Resolution with the Recorder of Contra Costa County.
