Subject/Title: Adopt a Resolution approving and authorizing the City Manager or designee to execute a Professional Services Agreement with LPA, Inc. for design services in connection with the work referred to as LEED Services (Leadership in Energy and Environmental Design) / Sustainable Design for the Civic Center projects in an amount not to exceed $63,000, plus a 10% contingency of $6,300, for a total of $69,300.

RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager or designee to execute a Professional Services Agreement with LPA, Inc. for design services in connection with the work referred to as LEED Services (Leadership in Energy and Environmental Design) / Sustainable Design for the Civic Center projects in an amount not to exceed $63,000, plus a 10% contingency of $6,300, for a total of $69,300.

PREVIOUS ACTION
On July 23, 2006, the City entered into an interim agreement with LPA for architectural planning, pre-design and related services in order to facilitate the City Hall project while the formal agreement between the parties was being negotiated.

On April 24, 2007, by Resolution No. 2007-89, City Council approved and authorized the City Manager to execute an agreement with LPA, Inc., for the architectural planning, design and related services of the New City Hall (CIP No. 337-31390), including the Civic Center Parking Facility and Civic Center Plaza in an amount not to exceed $2,922,218, plus 10% contingency of $292,221 for a total of $3,214,439.80.

On June 12, 2007, by Resolution No. 2007-126, City Council adopted the Negative Declaration and adopted the 2007/08 - 2011/12 Capital Improvement Program.

On August 14, 2007, by Resolution 2007-190, City Council adopted the Civic Center Master Site Plan and directed staff to pursue basic LEED Certification as a minimum on the Civic Center Buildings.

BACKGROUND
Staff is interested in pursing LEED certification for the Civic Center buildings, which is a system of points for utilizing “green” building components for energy efficiencies. These components have not been identified yet, but will be reviewed and defined at various levels of the project. Staff believes that a smart sustainable design approach will also contribute to the aesthetic direction and become an educational model for generations to come. Staff will periodically update City Council on the status of the project and request approvals at various levels of design and construction. Inclusive in these updates, where applicable, will be components of the building design that may increase our LEED certification levels. Staff will provide the cost of these components, along with the return on investment, in order for Council to make an appropriate determination on the certification level.

FISCAL IMPACT
The fiscal impact of this agreement is $63,000, plus a 10% contingency of $6,300, for a total amount of $69,300. The total amount of $69,300 will be allocated as follows:

$38,115 for the New City Hall project (CIP No. 337-37205)
$20,097 for the New Community Center project (CIP No. 337-37195)
$7,623 for the Civic Center Parking Facility project (CIP No. 337-37196)
$2,079 for the City Park project (CIP No. 352-52406)
$1,386 for the Civic Center Plaza project (CIP No. 337-37193)

The funds for this work are included in the adopted 2007/08-2011/12 Capital Improvement Program, which includes the Civic Center projects.

A RESOLUTION APPROVING AND AUTHORIZING THE CITY MANAGER OR DESIGNEE TO EXECUTE A PROFESSIONAL SERVICES AGREEMENT WITH LPA, INC. NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of Brentwood hereby approves and authorizes the City Manager or designee to execute a Professional Services Agreement with LPA, Inc. for design services in connection with the work referred to as LEED Services (Leadership in Energy and Environmental Design) / Sustainable Design for the Civic Center projects in an amount not to exceed $63,000, plus a 10% contingency of $6,300, for a total of $69,300.
