RECOMMENDATION
Adopt a Resolution approving the Brentwood Grown certification mark and authorize the City Manager or designee to execute appropriate documentation with the United States Patent and Trademark office for use of the term and logo, Brentwood Grown.

BACKGROUND
Staff has been working on the design development of the “Brentwood Grown” certification mark. City staff applied for and has received initial rights to use the term Brentwood Grown from the United States Patent and Trademark Office (USPTO). As part of our application to use this term, the City needs to develop an identity or logo for the Brentwood Grown program and must contract with at least one local grower to use the term and logo as proof of implementation.

Attached to this staff report (Exhibit A) is the recommended design concept. The design of the mark included considerable input from area farmers and local marketing organizations held over the past several months. The logo incorporates the various crops and landmarks that make Brentwood unique, including a graphical interpretation of various row crops, vines and orchards. Staff provided direction to the designer to include the same font styles used in the City’s logo, as well as Mount Diablo, a distinguishable landmark locally and another major component of the City’s own logo identity.

If the Council decides to approve the Brentwood Grown logo and provide the authorization to the City Manager or designee to complete the statement of use filing, staff will begin work on the legal language for the use agreements between the farmers/local marketing organizations and the City, with respect to the use of the term and logo. The form use agreement will come back before the full Council for approval prior to the execution of any such agreements.

FISCAL IMPACT
The fiscal impact of this item is related to the legal fees to complete this application with the USPTO. Legal services have been budgeted in the Agricultural Administration 262 for the 2007/08 Operating Budget.

ADOPT A RESOLUTION APPROVING THE BRENTWOOD GROWN CERTIFICATION MARK AND AUTHORIZING THE CITY MANAGER OR DESIGNEE TO EXECUTE APPROPRIATE DOCUMENTATION WITH THE UNITED STATES PATENT AND TRADEMARK OFFICE FOR USE OF THE TERM AND LOGO, BRENTWOOD GROWN

WHEREAS, city staff applied for and has received the initial rights to use the term Brentwood Grown from the United States Patent and Trademark Office (USPTO), and staff has been working on the design development of the “Brentwood Grown” certification mark; and

WHEREAS, a part of the application to use the term, the City needs to develop an identity or logo for the Brentwood Grown program and must contract with at least one local grower to use the term and identity as proof of implementation; and

WHEREAS, the recommended design concept included considerable input from area farmers and local marketing organizations held over the past several months. The logo incorporates the various crops and landmarks that make Brentwood unique, including a graphical interpretation of various row crops, vines and orchards; and

NOW, THEREFORE BE IT RESOLVED, the City Council of the City of Brentwood approves the Brentwood Grown Certification Mark as shown in Exhibit A and authorizes the City Manager or designee to execute appropriate documentation with the United States Patent and Trademark office for use of the term and logo, Brentwood Grown.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 26th day of February 2008 by the following vote:
