RECOMMENDATION
Adopt a Resolution accepting the public improvements for maintenance; accepting all right-of-way offers of dedication in-fee; accepting all easements, abutter’s rights and sub-surface mineral and water rights as shown on the Final Map; accepting the Maintenance Bond; and releasing the Improvement Securities for Subdivision No. 8481, constructed by Western Pacific Housing/D.R. Horton, located south of Balfour Road and west of Foothill Drive.

PREVIOUS ACTION
On January 19, 1993, by Resolution No. 93-2, Planning Commission approved Tentative Subdivision Map No. 7690, with conditions.

On April 22, 2003, by Resolution No. 2834, City Council approved the Final Map and associated Subdivision Improvement Agreement for Subdivision No. 8481.

BACKGROUND
This subdivision, located south of Balfour Road and west of Foothill Drive within the Deer Ridge Development, has been developed by Western Pacific Housing/D.R. Horton (“Developer”) and contains 64 single-family residential lots. All public improvements required by the project’s Conditions of Approval have been constructed and inspected for conformance with the approved improvement plans including sewer, water and storm drain lines, sidewalk, paving, streetlights and fiber optic conduit. This project is one of the twenty villages within the Deer Ridge master planned community.

As shown on the improvement plans, the Developer has installed the following improvement quantities: 2,148 linear feet (“LF”) of 8” sewer lines, 1,850 LF of 8” water lines, 973 LF of 18” storm drain lines, 4,642 LF of curb and gutter, 4,643 LF of 5’ sidewalk, 2,942 LF of pavement, 15 streetlights and 3,482 LF of joint trench including fiber optic conduit. The Developer has provided a Maintenance Bond to cover the twelve-month warranty period for the public improvements.

The necessary right-of-way offers of dedication and easements required for maintenance of the public improvements were offered to the City as a part of the Final Map. With the improvements now installed, it is the appropriate time to accept the offers of dedication and improvements to begin the warranty period.

FISCAL IMPACT
Upon acceptance of improvements, the City will incur annual costs associated with necessary maintenance of streets, landscaping and utilities. Routine roadway maintenance will be funded by the General Fund and Measure “C” transportation sales tax, with sewer and water maintenance funded through their respective enterprise funds. Landscaping and Lighting Assessment District (“LLD”) No. 99-5 has been formed for this subdivision and will be responsible for the street lighting and landscaping maintenance.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE PUBLIC IMPROVEMENTS FOR MAINTENANCE; ACCEPTING ALL RIGHT-OF-WAY OFFERS OF DEDICATION IN-FEE; ACCEPTING ALL EASEMENTS, ABUTTER’S RIGHTS AND SUB-SURFACE MINERAL AND WATER RIGHTS AS SHOWN ON THE FINAL MAP; ACCEPTING THE MAINTENANCE BOND; AND RELEASING THE IMPROVEMENT SECURITIES FOR SUBDIVISION NO. 8481, CONSTRUCTED BY WESTERN PACIFIC HOUSING/D.R. HORTON, LOCATED SOUTH OF BALFOUR ROAD AND WEST OF FOOTHILL DRIVE.

WHEREAS, January 19, 1993, by Resolution No. 93-2, Planning Commission approved Tentative Subdivision Map No. 7690, with conditions; and

WHEREAS, on April 22, 2003, by Resolution No. 2834, City Council approved the Final Map and associated Subdivision Improvement Agreement for Subdivision No. 8481; and

WHEREAS, rights-of-way, easements, and other rights necessary for public maintenance were offered for dedication to the City as a part of the Final Map and accepted subject to acceptance of improvements; and

WHEREAS, the required public improvements, have been completed and constructed in substantial conformance with the approved improvement plans; and

WHEREAS, Western Pacific Housing/D.R. Horton has posted Maintenance Bonds, guaranteeing materials and workmanship, for a period of one year following acceptance of improvements.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood with respect to Subdivision No. 8481, developed by Western Pacific Housing/D.R. Horton that:

1. All public improvements are hereby accepted for maintenance.
2. All right-of-way dedications as offered on the Final Map are hereby accepted in fee.
3. All easements, abutter’s rights, and sub-surface mineral and water rights are hereby accepted.
4. The Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.
5. The Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this Resolution.
6. The City Clerk is hereby directed to file this Resolution with the Recorder of Contra Costa County.
