RECOMMENDATION
Adopt a resolution accepting Sand Creek Road right-of-way and median landscaping improvements and warranty bond for Subdivision No. 8551, Gregory Ranch Townhomes, located south of Sand Creek Road, east of Marsh Creek and west of Brentwood Boulevard, by D. R. Horton.

PREVIOUS ACTION
On July 16, 2002, by Resolution No. 02-30, Planning Commission amended PD-42 by adding development standards for planning area D, and approved Tentative Subdivision Map No. 8551, with conditions.

On August 3, 2004, by amended Resolution No. 02-30, the Planning Commission approved Subdivision #8551 for a one-year time extension for Design Review 01-19, with the elimination of the City’s Affordable Housing Ordinance, condition #51.

On June 3, 2004, a subdivision agreement was made and entered between the City of Brentwood and Western Pacific Housing for Subdivision No. 8851.

On January 25, 2005, an agreement was made and entered between the City of Brentwood and Western Pacific Housing for Subdivision No. 8894, Coppergate as re-subdivision of a portion of Subdivision 8551.

BACKGROUND
Subdivision No. 8551 is located on the south side of Sand Creek Road, east of Marsh Creek and west of Brentwood Boulevard, and was developed by Western Pacific Housing (“Developer”) and contains 120 townhouse lots

As part of Subdivision No. 8551 improvement plans and as part of the Conditions of Approval requirements, the developer dedicated a 20-foot wide landscape easement along the entire frontage and immediately adjacent to Sand Creek Road and O’Hara Avenue, and to construct the landscaping and irrigation system on the southside and center median along Sand Creek Road from O’Hara Avenue to easterly edge of the Gamay Drive extension.

The Developer for Subdivision 8851, re-subdivision for 8894 and development of the subdivisions 8551 & 8894, Western Pacific Housing was purchased and become part of D. R. Horton.

The Developer has installed the following improvements: approximately 1400 feet of median landscaping along Sand Creek Road and approximately 20 feet wide by 700 feet of Sand Creek Road right-of-way adjacent to the development.

FISCAL IMPACT
Upon acceptance of median and road right-of-way improvements, the City will incur annual costs associated with the necessary maintenance of the landscape improvements. The yearly estimated total maintenance cost for the median and road right-of-way is $2,000. Landscape and Lighting Assessment District No 02-5 has been formed for this subdivision to cover these costs.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING SAND CREEK ROAD RIGHT-OF-WAY AND MEDIAN LANDSCAPING IMPROVEMENTS AND MAINTENANCE BOND FOR SUBDIVISION #8551, GREGORY RANCH TOWNHOMES, LOCATED SOUTH OF SAND CREEK ROAD, EAST OF MARSH CREEK AND WEST OF BRENTWOOD BOULEVARD, BY D. R. HORTON.


WHEREAS, on July 16, 2002 and again on August 3, 2004, by Resolution No. 02-30, Planning Commission approved Tentative Subdivision Map No. 8551, with conditions; and

WHEREAS, on June 3, 2004, a subdivision agreement was made and entered between the City of Brentwood and Western Pacific Housing Inc. for Subdivision 8551; and

WHEREAS, on January 25, 2005, a subdivision agreement was made and entered between the City of Brentwood and Western Pacific Housing, Inc. for Subdivision 8894, Coppergate as re-subdivision of a portion of Subdivision 8851; and

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood accepts Sand Creek Road right-of-way and median landscaping with respect to Subdivision 8851, Gregory Ranch Townhomes, developed by D. R. Horton formally known as Western Pacific Housing.
