RECOMMENDATION
Adopt a Resolution amending the CIP Budget Sheet for the Aquatic Complex Improvements Project, CIP No. 352-52403.

PREVIOUS ACTION On September 28, 1999, the Council awarded the construction contract for the City of Brentwood Family Aquatic Complex (CIP No. 522-5202) to Shoemate Buildings, Inc.

On February 13, 2001, City Council accepted the work performed by Shoemate Buildings, Inc. for the City of Brentwood Family Aquatic Complex (CIP Project No. 522-5202 and directed the City Clerk to file a notice of completion with the recorder’s office of Contra Costa County.

On June 12, 2007, by Resolution 2007-126, City Council adopted the 2007/08 – 2011/12 CIP, which included the Aquatic Complex Improvement Project, CIP No. 352-52403.

On January 22, 2008, by Resolution 2008-17, City Council awarded the construction agreement with Carrier Corporation Inc. for replacement of boilers at the Brentwood Family Aquatic Complex under the Aquatic Complex Improvement Project, CIP 352-52403 and also amending the CIP Budget sheet for the Aquatic Complex Improvement Project, CIP 352-52403.

BACKGROUND Currently there are ten (10) sand filters in place at the Brentwood Family Aquatic Complex. Three years ago, one sand filter began to leak and was replaced. A second filter has begun to leak and needs to be replaced. Additionally, the County Health Department has mandated the replacement of this filter.

The filter that is currently leaking has a partial warranty remaining on it. The cost to purchase a new filter, plus tax and freight is $12,423.00. The warranty pro-rated discount will reduce the priced by $4369.00, for a total of $8,054.00. We have acquired bids for the removal of the old filter and installation of the new filter (that we are purchasing) in the amount of $16,033 plus $1,603.30 contingency.

Staff had originally looked at trying to bid both the boiler replacement and filter replacements together but encountered problems with finding trades who specialized in both. As a result, each was bid separately.

FISCAL IMPACT
The total cost of this proposal is $25,690.00, $8054.00 for the new filter and $16,033.00, plus a 10% of $1,603.30 contingency for removal and installation of filter. The Aquatic Complex Improvement project, CIP #352-52403, is included in the adopted 2007/08 – 2011/12 Capital Improvement Program. The funding source for the CIP project is the Facilities Replacement Fund.


The Amended Budget and the proposed new Amended Budget are shown below.

The total increase to the FY 2007/08 project budget is $25,690.00. This is a one-time charge which will be funded by Facilities Replacement Fund. Finance has confirmed there are sufficient funds for this increase and no revenue offsets are expected due to this amendment. There will be no known future costs for this project.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AMENDING THE CIP BUDGET SHEET FOR THE AQUATIC COMPLEX IMPROVEMENTS PROJECT, CIP NO. 352-52403


WHEREAS, On September 28, 1999, the City Council awarded the construction contract for the City of Brentwood Family Aquatic Complex (CIP No. 522-5202) to Shoemate Buildings, Inc.; and

WHEREAS, On February 13, 2001, the City Council accepted the work performed by Shoemate Buildings, Inc. for the City of Brentwood Family Aquatic Complex (CIP Project No. 522-5202 and directed the City Clerk to file a notice of completion with the recorder's office of Contra Costa County; and

WHEREAS, On June 12, 2007, by Resolution 2007-126, City Council adopted the 2007/08 – 2011/12 CIP, which included the Aquatic Complex Improvement Project, CIP No. 352-52403; and

WHEREAS, On January 22, 2008, by Resolution 2008-17 City Council awarded a construction agreement for the replacement of boilers with Carrier Corporation Inc. for the Aquatic Complex Improvements Project (CIP No. 352-52403) and amended the budget sheet for the Aquatic Complex Improvement Project (CIP No. 352-52403); and

WHEREAS, a leaking filter must be replaced before the April 26, 2008 opening of the Brentwood Family Aquatic Complex in order to avoid any closures related to the failure of the pool heaters; and

WHEREAS, staff is recommending that the CIP Budget for the Aquatic Complex Improvements be increased to $163,776 to reflect the additional $25,690 from the Facilities Replacement Fund; and

WHEREAS, the Finance Department has confirmed that there are sufficient funds to cover the proposed amended budget; and

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Brentwood does hereby amend the CIP Budget Sheet for the Aquatic Complex Improvements, CIP Project No. 352-52403 as further described in the attached Exhibit “A”.
