Subject/Title: Adopt a resolution accepting road right-of-ways landscaping improvements and maintenance bonds for DR 03-02, Brentwood Senior Commons, located north of Oak Street, west of Garin Parkway, and east of Larkspur Way, by Eden Housing, Inc.

RECOMMENDATION
Adopt a resolution accepting road right-of-ways landscaping improvements and maintenance bonds for DR 03-02, Brentwood Senior Commons, located north of Oak Street, west of Garin Parkway, and east of Larkspur Way, by Eden Housing, Inc.

PREVIOUS ACTION
On February 18, 2003, by Resolution No. 03-08, the Planning Commission approved Design Review No. 03-02 (DR 03-02) for the construction of an 80-unit senior housing apartment development and an approximately 1,600 square foot community building and approved Condition Use Permit No. 01-26 (CUP 01-26).

On March 16, 2004, by Resolution No. 04-13, the Planning Commission approved a one year time extension for DR 03-02 and CUP 01-26, with conditions.

On November 9, 2004, by Resolution No. 2004-260, City Council authorized reservation of housing trust funds in an amount not to exceed $1,000,000 to Eden Housing, Inc. a non-profit housing development corporation, for the development of Brentwood Senior Commons.

On January 25, 2005, by Resolution No. 2005-16, City Council authorized execution of a participation and loan agreement between the Redevelopment Agency of the City of Brentwood and Eden Housing, Inc., and approved a loan in the amount of $900,000 to assist in the construction of Brentwood Senior Commons.

On February 15, 2005, by Resolution No. 05-14, the Planning Commission approved an two year time extension for Design Review 03-02 (DR 03-02) and conditional use permit 01-26 (CUP 01-26), with conditions.

BACKGROUND
The Brentwood Senior Commons project is located on the northwest corner of Oak Street and Garin Parkway, will be developed by Eden Housing, Inc. and contains 80-unit senior apartments.

As part of DR 03-02 and CUP01-26 improvement plans and Conditions of Approval requirements, the Developer dedicated a 15-foot wide landscape easement along the entire frontage and immediately adjacent to Oak Street, and agreed to dedicate 7.5-foot landscape easement along the entire frontage and immediately adjacent to Garin Parkway.

The Developer has installed the following improvements: approximately 430 feet long by 15 feet wide on the north side of Oak Street road right-of-way and approximately 375 feet long by 7.5 wide landscape improvements along the west side of Garin Parkway.

The Developer has provided Maintenance Bonds to cover the twelve-month warranty period for the Oak Street and Garin Parkway road right-of-ways.

FISCAL IMPACT
Upon accepting the road right-of-ways improvements, the City will incur annual costs associated with the necessary maintenance of the landscape improvements. The yearly estimated total maintenance cost for the road right-of-ways is $1,500. Landscape and Lighting Assessment District No. 02-2 has been formed for this development to cover these costs.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING ROAD RIGHT-OF-WAYS LANDSCAPE IMPROVEMENTS AND MAINTENANCE BONDS FOR DR 03-02, BRENTWOOD SENIOR COMMONS, LOCATED NORTH OF OAK STREET, WEST OF GARIN PARKWAY, BY EDEN HOUSING, INC.


WHEREAS, on February 18, 2003, by Resolution No. 03-08, the Planning Commission approved DR 03-02 for the construction of an 80-unit senior housing apartment development and an approximately 1,600 square foot community building and approving CUP 01-26; and

WHEREAS, on November 9, 2004, by Resolution No. 2004-260, City Council authorized reservation of housing trust funds in an amount not to exceed $1,000,000 to Eden Housing, Inc. a non-profit housing development corporation, for the development of Brentwood Senior Commons; and

WHEREAS, on March 16, 2004, by Resolution No. 04-13, the Planning Commission approved a one-year time extension for Design Review 03-02 (DR 03-02) and conditional use permit 01-26 (CUP 01-26), with conditions; and

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood accepts the road right-of-ways landscape improvements and maintenance bonds for DR 03-02, Brentwood Senior Commons, by Eden Housing, Inc.
