Adopt a Resolution accepting all off-site public improvements for maintenance; accepting the maintenance bond and releasing the Improvement Securities for Design Review No. 04-07, Harvest Commerce Center (“Developer”), located at Brentwood Boulevard and Griffith Lane.
On October 5, 2004, by Resolution No. 04-59, Planning Commission approved Design Review No. 04-07, with conditions.
This project, located at the corner of Brentwood Boulevard and Guthrie Lane, was approved for five (5) light industrial buildings totaling a maximum of 58,233 square feet. All improvements required by the Conditions of Approval for this project, such as curb, gutter, sidewalk, paving and utility connections, have been constructed and inspected for conformance with the approved improvement plans.
As a part of this project the Developer has installed the following public improvements: 12” storm drain line, 6” sewer line, 2” and 8” water lines, fire hydrants, paving and bus turnout, curb, gutter, sidewalk and parkway landscaping.
The Developer has provided a Maintenance Bond to cover the twelve-month warranty period for the public improvements. With the improvements now installed to the satisfaction of the City, it is the appropriate time to accept the improvements and begin the warranty period.
Most of the improvements associated with this project are privately owned and maintained; therefore, upon acceptance the City will incur only minimal annual costs associated with necessary maintenance of the public paving and concrete. Routine roadway maintenance will be funded by the General Fund and Measure “C” transportation sales tax, with sewer and water maintenance funded through their respective enterprise funds. The property owner has executed a License Agreement to maintain the parkway landscaping, though Landscaping and Lighting Assessment District (LLD) No. 05-2 has been formed in the event maintenance does not meet City Standards.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING ALL OFF-SITE PUBLIC IMPROVEMENTS FOR MAINTENANCE; ACCEPTING THE MAINTENANCE BOND, AND RELEASING THE IMPROVEMENT SECURITIES FOR DESIGN REVIEW NO. 04-07, HARVEST COMMERCE CENTER, LOCATED AT BRENTWOOD BOULEVARD AND GRIFFITH LANE.
WHEREAS, on October 5, 2004, by Resolution No. 04-59, Planning Commission approved Design Review No. 04-07, with conditions; and
WHEREAS, the required public improvements have been completed and constructed in substantial conformance with the approved improvement plans; and
WHEREAS, Harvest Commerce Center (“Developer”) has posted a Maintenance Bond, guaranteeing materials and workmanship for a period of one year following acceptance of improvements.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood with respect to Design Review No. 04-07, Harvest Commerce Center that:
1. All off-site public improvements are hereby accepted for maintenance.
2. The Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.
3. The public improvement securities will be released within sixty (60) days of the passage of this Resolution.
4. The City Clerk is hereby directed to file this Resolution with the Recorder of Contra Costa County.
