Subject/Title: Approve the re-appointment of Lanny Brown and Ernie Rodrigues to the Park and Recreation Commission for a three-year term expiring December 31, 2010.

RECOMMENDATION
Approve the re-appointment of Lanny Brown and Ernie Rodrigues to the Park and Recreation Commission for a three-year term expiring December 31, 2010.

PREVIOUS ACTION
On October 12, 1999, the City Council approved Ordinance 624 forming the Park and Recreation Commission.

On December 11, 2001, City Council approved the reappointment of Lanny Brown and the appointment of Ernie Rodrigues to the Park and Recreation Commission for 3-year terms that
would expire December 31, 2004.

On December 14, 2004, City Council re-appointed Lanny Brown and Ernie Rodrigues to the City of Brentwood Park and Recreation Commission for three-year terms beginning January 1, 2005 and ending December 31, 2007.

BACKGROUND
The terms for Lanny Brown and Ernie Rodrigues on the Park and Recreation Commission expired on December 31, 2007. Staff advertised the vacancy and the only applications received were from Commissioners Brown and Rodrigues. Staff met with Vice Mayor Brockman and Council member Stonebarger who are assigned as liaisons to the Park and Recreation Commission to consider the openings.

One of the issues discussed relates to the fact that the current ordinance Park and Recreation Commission Chapter 2.46.040 Terms of Office states, in part:

“The maximum term for any commissioner is three consecutive three-year terms”.

Commissioner Brown was an original appointee to the Park and Recreation Commission and was given a partial term that expired in December 2001. As a result, he has served 1 two-year term, and 2 three-year terms. The liaisons believe that Chapter 2.46.040 was intended to give each Commissioner the opportunity to serve 3 three-year terms and as a result, are recommending that Commission Brown be allowed to serve one additional three-year term. Vice Mayor Brockman and Council member Stonebarger are recommending the re-appointment of both Commissioners to three years terms that will expire on December 31, 2010.

FISCAL IMPACT
There is no fiscal impact.
