Adopt a Resolution accepting all off-site public improvements for maintenance; accepting the Maintenance Bond; and releasing the Improvement Securities for Design Review No. 05-21, developed by R. Brothers Concrete, Inc., (“Developer”), located in the Sunset Industrial Complex.
On April 18, 2006, by Resolution No. 06-05, Planning Commission approved Design Review No. 05-21, with conditions.
This project, located north of Beatrice Court and on the east side of Elkins Way within the Sunset Industrial Complex, was approved for the development of two industrial buildings totaling 14,400 Square Feet (“SF”). All improvements required by the Conditions of Approval for this project, such as curb, gutter, sidewalk, paving and utility connections, have been constructed and inspected for conformance with the approved improvement plans. The Developer has provided Maintenance Bonds to cover the twelve-month warranty period for all public improvements.
As a part of the project the Developer has installed the following improvement quantities: 687 Lineal Feet (“LF”) of various diameter storm drain lines, 378 LF of 6” sewer line, 623 LF of waterline, 47,500 SF of paving, 1,760 SF of curb and gutter and 2,400 SF of sidewalk.
With the improvements now installed to the satisfaction of the City, it is the appropriate time to accept the public improvements and begin the warranty period.
Most of the improvements associated with this project are privately owned and maintained; therefore, upon acceptance the City will incur only minimal annual costs associated with necessary maintenance of the public paving and concrete. Routine roadway maintenance will be funded by the General Fund and Measure “C” transportation sales tax, with sewer and water maintenance funded through their respective enterprise funds. Landscaping and Lighting Assessment District (“LLD”) No. 02-12, has been formed for this subdivision and will be responsible for the street lighting and landscaping maintenance in public areas.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING ALL OFF-SITE PUBLIC IMPROVEMENTS FOR MAINTENANCE; ACCEPTING THE MAINTENANCE BOND; AND RELEASING THE IMPROVEMENT SECURITIES FOR DESIGN REVIEW NO. 05-21, DEVELOPED BY R. BROTHERS CONCRETE, INC., LOCATED IN THE SUNSET INDUSTRIAL COMPLEX.
WHEREAS, on April 18, 2006, by Resolution No. 06-05, Planning Commission approved Design Review No. 05-21, with conditions; and
WHEREAS, the required improvements have been completed and constructed in substantial conformance with the approved improvement plans; and
WHEREAS, the Developer has posted a Maintenance Bond, guaranteeing materials and workmanship, for a period of one year following acceptance of improvements.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood with respect to Design Review No. 05-21, developed by R. Brothers Concrete, Inc., that:
1. All off-site public improvements are hereby accepted for maintenance.
2. The Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.
3. The Improvement Securities will be released within sixty (60) days of the passage of this Resolution.
4. The City Clerk is hereby directed to file this Resolution with the Recorder of Contra Costa County.
