RECOMMENDATION
Approve a Resolution accepting the Fourth Annual Residential Growth Management Program (RGMP) Allocation Recommendation as submitted by the RGMP Allocation Recommendation Committee for calendar year 2008.

PREVIOUS ACTION
On February 13, 2001, the City Council directed the City Council Housing Subcommittee and staff to move forward with preparation of the RGMP.

On July 6, 2001, the City Council adopted the RGMP through Resolution No. 2326, which was effective July 1, 2001.

On September 14, 2004, the City Council directed staff to amend the RGMP to address Council concerns.

On October 12, 2004, the City Council approved Resolution No. 2004-242 adopting the 2004 revision to the Residential Growth Management Program (Alternate B) and dissolving the RGMP Council Subcommittee.

On February 8, 2005, the City Council approved Resolution No. 2005-39 adopting the First Annual RGMP Allocation Recommendation as submitted by the RGMP Allocation Recommendation Committee.

On September 13, 2005, the City Council approved Resolution No. 2005-228 adopting an update to the Residential Growth Management Program (RGMP).

On January 10, 2006, the City Council approved Resolution No. 2006-3 accepting the Second Annual Residential Growth Management Program Allocation Recommendation as submitted by the RGMP Allocation Recommendation Committee for calendar year 2006.

On October 24, 2006, the City Council approved Resolution No. 2006-274 adopting an update to the RGMP.
On January 9, 2007, the City Council approved Resolution No. 2007-1 accepting the Third Annual Residential Growth Management Program Allocation Recommendation as submitted by the RGMP Allocation Recommendation Committee for calendar year 2007.

BACKGROUND
Pursuant to the Residential Growth Management Program, the RGMP Annual Allocation Schedule runs with the calendar year from January 1 through December 31. The proposed annual allocation and annual updates to the program are presented to the City Council by the Finance Director, Community Development Director and the Director of Public Works/City Engineer (the RGMP Allocation Recommendation Committee) at the first regularly scheduled Council meeting of each calendar year to ensure that the program remains flexible and adjusts to the needs of the community as it evolves. The program states that in no case shall the Committee recommend an annual allocation in excess of 600 units.

The Annual Allocation which may be granted each year is to be consistent with the annual number of dwelling units necessary to promote the public health, safety and welfare by maintaining the small town character and quality of life of Brentwood, and its open spaces, enabling Brentwood to grow at an orderly, well planned and deliberate pace.

The current RGMP, as most recently amended by the Council in October of 2006, sets two dates for review of allocation applications – the second Council meeting in February and the second Council meeting in August. The First Annual RGMP Allocation for calendar year 2005 was set at 433 units. A total of four applications and 420 units were allocated in 2005. The Second Annual RGMP Allocation for calendar year 2006 was set at 400 units. A total of five applications and 189 units were allocated in 2006. The Third Annual RGMP Allocation for calendar year 2007 was set at 451 units. A total of one application and 154 units were allocated in 2007.

After review and discussion, the RGMP Allocation Recommendation Committee recommends that the City Council establish the annual allocation for calendar year 2008 at 500 units, which is consistent with Alternate “B”, as approved by the Council in October of 2004.

FISCAL IMPACT
There is no fiscal impact associated with the Council’s action.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE FOURTH ANNUAL RESIDENTIAL GROWTH MANAGEMENT PROGRAM (RGMP) ALLOCATION RECOMMENDATION AS SUBMITTED BY THE RGMP ALLOCATION RECOMMENDATION COMMITTEE FOR CALENDAR YEAR 2008.

WHEREAS, on February 13, 2001, the City Council directed the City Council Housing Subcommittee and staff to move forward with preparation of the Residential Growth Management Program (RGMP); and

WHEREAS, on July 6, 2001, the City Council Housing Subcommittee and staff recommended and the Council adopted the RGMP through Resolution No. 2326; and

WHEREAS, on September 14, 2004, the City Council directed staff to amend the RGMP to address Council concerns; and

WHEREAS, on October 12, 2004, the City Council approved Resolution No. 2004-242 adopting the 2004 revision to the Residential Growth Management Program (Alternate B) and dissolving the RGMP Council Subcommittee; and

WHEREAS, Alternate B recommended an initial allocation of 433 units for calendar year 2005, and by passing Resolution No. 2005-39 on February 8 2005, the City Council adopted the first annual RGMP allocation recommendation for an annual allocation in Calendar Year 2005 of 433 units; and

WHEREAS, on September 13, 2005, the City Council approved Resolution No. 2005-228 adopting an update to the Residential Growth Management Program; and

WHEREAS, in December 2005, the RGMP Allocation Recommendation Committee met and considered the appropriate number of units to be allocated for calendar year 2006, and recommended that the City Council establish an annual allocation of 400 units for calendar year 2006; and

WHEREAS, in January 2006, the City Council approved Resolution No. 2006-3 accepting the Second Annual Residential Growth Management Program Allocation Recommendation as submitted by the RGMP Allocation Recommendation Committee for calendar year 2006; and

WHEREAS, on October 24, 2006, the City Council approved Resolution No. 2006-274 adopting an update to the Residential Growth Management Program; and

WHEREAS, in November 2006, the RGMP Allocation Recommendation Committee met and considered the appropriate number of units to be allocated for calendar year 2007, and recommended that the City Council establish an annual allocation of 451 units for calendar year 2007; and

WHEREAS, in January 2007, the City Council approved Resolution No. 2007-1 accepting the Third Annual Residential Growth Management Program Allocation Recommendation as submitted by the RGMP Allocation Recommendation Committee for calendar year 2007; and

WHEREAS, in November 2007, the RGMP Allocation Recommendation Committee met and considered the appropriate number of units to be allocated for calendar year 2008, and now recommends that the City Council establish an annual allocation of 500 units for calendar year 2008; and

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood approves the RGMP allocation recommendation of 500 units for calendar year 2008.

Fourth Annual
RGMP Allocation Recommendation

This Fourth Annual RGMP Allocation report and recommendation is intended to establish the minimum number of units necessary to promote the public health, safety and welfare, maintain the small-town character and quality of life Brentwood is known for, and in particular, to slow the growth rate and firmly establish a competition for the available allocations.

At this time, there is one application totaling 58 units being processed for the 2008 allocation. Allocations are recommended to be granted in February and August with 50% proposed for each allocation period. In order to assure a healthy and spirited competition, the first allocation period in February should not provide all of the allocations requested, and should clearly set up further competition for the August period.

The RGMP Allocation Recommendation Committee recommends an allocation for calendar year 2008 of 500 units, which is consistent with the originally approved Alternate B. This allocation volume will not only set up a spirited competition for allocations in February, but also assure the same in August. Previous entitlements will assure far more than the 450 building permits in 2008 necessary for bond repayment schedules. The Committee is concerned, however, that allocating fewer units than Alternate B may depress the commercial development momentum in the City and be counter-productive to the program rather than be helpful.

We do not have any recommended revisions or updates at this time to the program, but may return to Council from time to time with possible updates, or fine-tuning in order to continually improve and perfect the program.

Appendix 1

Previous Allocations were on a fiscal year basis. Conversion to calendar year was accomplished by dividing the previous allocation between the two calendar years equally.
