Adopt a Resolution adopting the Mitigated Negative Declaration and Mitigated Monitoring Reporting Plan for the Harvest Park Basin, CIP Project No. 391-39030.
On June 12, 2007, by Resolution No. 2007-126, City Council adopted the City’s 2007/08 – 2011/12 Capital Improvement Program (“CIP”), which included the Harvest Park Basin, CIP Project No. 391-39030.
The Harvest Park Basin located at the corner of Harvest Park Drive and Guthrie Lane was constructed to hold overflow storm runoff from Storm Drain Lines I and J. The Harvest Park Basin was intended to be temporary and needed until Storm Drain Line A was constructed between Marsh Creek and the Sellers Avenue Basins. Construction of Storm Drain Line A allows storm runoff to flow through to Marsh Creek from the Sellers Avenue Basins and eliminates the need for the overflow capacity provided by the Harvest Park Basin. Storm Drain Line A will be completed prior to the filling of the Harvest Park Basin. The storm drain system as described above is shown on the Contra Costa Flood Control Hydrology Map for Drainage Area 52C.
This project will disconnect the Harvest Park Basin from the storm drain system and fill the detention basin producing 2.87 acres of useable land. All existing trees and connections to the storm drain system within the basin will be removed.
The zoning for this land is designated as Mixed-Use Business Park under the General Plan and is zoned Planned Development 12 (Sub-area B). The City will work with the Redevelopment Agency to look into selling the land to a private party for development of the land.
Vinnedge Environmental Consulting was hired as the environmental consultant for this project on July 12, 2007. The contract with Vinnedge Environmental Consulting includes all necessary biological studies and permitting consulting to assist in permits from other jurisdictional agencies.
Vinnedge Environmental Consulting completed the Initial Study (“IS”)/Mitigated Negative Declaration (“MND”) in accordance with the California Environmental Quality Act (“CEQA”), which requires state and local government agencies to consider the environmental consequences of the proposed project. The intent of the IS/MND is to provide information concerning any potential environmental effects of the proposed project and to indicate possible ways to reduce or avoid potential significant effects. The IS/MND was circulated for public and affected regulatory agencies review from October 15, 2007 to November 14, 2007. No comments were received and a final IS/MND has been prepared.
This is an administrative function with no fiscal impact to the project; however, some permit fees have been identified and funds associated with this work have been included in the adopted 2007/08 – 2011/12 Capital Improvement Program, which includes the Harvest Park Basin, CIP Project No. 391-39030.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ADOPTING THE MITIGATED NEGATIVE DECLARATION AND MITIGATED MONITORING REPORTING PLAN FOR THE HARVEST PARK BASIN, CIP PROJECT NO. 391-39030.
WHEREAS, on May 23, 2006, by Resolution No. 2006-126, City Council adopted the City’s 2007/08 – 2011/12 Capital Improvement Program (“CIP”), which included the Harvest Park Basin, CIP Project No. 391-39030; and
WHEREAS, the Harvest Park Basin is no longer needed to handle overflow storm runoff and will be filled in and sold to a private party for development; and
WHEREAS, a Mitigated Negative Declaration and Mitigated Monitoring Reporting Plan was prepared in conformation with California Environmental Quality Act, comments have been solicited from the public and affected regulatory agencies and no public or agency comments were received.
NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby adopt the Mitigated Negative Declaration and Mitigated Monitoring Reporting Plan for the Harvest Park Basin, CIP Project No. 391-39030 and make the following findings:
1. On the basis of the whole record there is no substantial evidence that the project will have a significant effect on the environment; and
2. The Mitigated Negative Declaration reflects the City of Brentwood’s independent judgment and analysis; and
3. The City is the custodian of the documents and other records which constitute the record of proceedings upon which this decision is based, which documents and other materials are located at the City of Brentwood, 150 City Park Way, Brentwood, CA 94513.
PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 11th day of December 2007 by the following vote:
