Subject/Title: Adopt a Resolution accepting the Storm Drain Line A, Drainage Area 52C public improvements for maintenance; accepting the Maintenance Bond; and releasing the Improvement Securities for these improvements, south of Sunset Road and north of Sycamore Avenue, constructed as a part of Standard Pacific Homes Subdivision No. 8548.

Adopt a Resolution accepting the Storm Drain Line A, Drainage Area 52C public improvements for maintenance; accepting the Maintenance Bond; and releasing the Improvement Securities for these improvements, south of Sunset Road and north of Sycamore Avenue, constructed as a part of Standard Pacific Homes (“Developer”) Subdivision No. 8548.
On September 13, 2005, by Resolution No. 2005-226, City Council approved Tentative Subdivision Map No. 8548 with conditions, and a Development Agreement with Barrington at Sand Creek, LLC (Standard Pacific Homes).
On September 12, 2006, City Council was notified through an Informational Report of the City Manager’s approval of Final Subdivision Map No 8548 and associated Subdivision Improvement Agreement.
Conditioned as a part of Tentative Subdivision Map No. 8548, the Developer constructed Storm Drain Line A in Flood Control Drainage Area 52C. This storm drain line is part of a master planned drainage system consisting of multiple detention basins and mainlines draining the east side of the City from Balfour Road northerly to Marsh Creek. This line is also one of the last portions of the system necessary to drain the existing detention basins on the east side of the City to prevent any overflowing. The Developer constructed the portion of line throughout their project running parallel to Garin Parkway from Jennifer Street north to Sunset Road. This scope of improvements consisting of 3,748 Lineal Feet (“LF”) of 34” storm drain line and associated appurtenances is complete and has been inspected for conformance with the approved improvement plans and has also been deemed complete by the Contra Costa County Flood Control and Water Conservation District. The Developer has provided a Maintenance Bond to cover the twelve-month warranty period for the public improvements.
The necessary right-of-way offers of dedication and easements required for maintenance of the public improvement were offered to the City and accepted as a part of the final map. With the improvements now installed, it is the appropriate time to accept the improvements and begin the warranty period.
Upon acceptance of improvements, the City will incur annual costs associated with necessary maintenance of storm drainage utilities to be funded by the General Fund. Landscaping and Lighting Assessment Districts (LLD) Nos. 95-8, 02-2 and 06-5 have been formed to fund maintenance of detention basin landscaping within Drainage Area 52C.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE STORM DRAIN LINE A, DRAINAGE AREA 52C PUBLIC IMPROVEMENTS FOR MAINTENANCE; ACCEPTING THE MAINTENANCE BOND; AND RELEASING THE IMPROVEMENT SECURITIES FOR THESE IMPROVEMENTS, SOUTH OF SUNSET ROAD AND NORTH OF SYCAMORE AVENUE, CONSTRUCTED AS A PART OF STANDARD PACIFIC HOMES SUBDIVISION NO. 8548.
WHEREAS, on September 13, 2005, by Resolution No. 2005-226, City Council approved Tentative Subdivision Map No. 8548 with conditions, and a Development Agreement with Barrington at Sand Creek, LLC (Standard Pacific Homes); and
WHEREAS, September 12, 2006, City Council was notified by an Informational Report of the City Manager’s approval of Final Subdivision Map No. 8548 and associated Subdivision Improvement Agreement; and
WHEREAS, the required public improvements, have been completed and constructed in substantial conformance with the approved improvement plans; and
WHEREAS, Standard Pacific Homes has posted a Maintenance Bond, guaranteeing materials and workmanship, for a period of one year following acceptance of improvements.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood with respect to Subdivision No. 8548 Storm Drain Line A, Drainage Area 52C, developed by Standard Pacific Homes that:
1. Storm Drain Line A, Drainage Area 52C public improvements are hereby accepted for maintenance.
2. The Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.
3. The Subdivision Performance and Payment Bonds for Storm Drain Line A, Drainage Area 52C will be released within sixty (60) days of the passage of this Resolution.
4. The City Clerk is hereby directed to file this Resolution with the Recorder of Contra Costa County.
